DonutNV 2nd Franchisee Daryl Poe Not Disclosed… Anywhere?
Daryl Poe was celebrated as DonutNV’s 2nd franchisee. The local paper states that he operates both the Pottstown PA brick-and-mortar location and an event trailer as a DonutNV franchisee. It’s unclear if the much-hyped sales and profit figures from a single affiliate trailer run out of Pottstown was operated by Daryl Poe. Much is unclear since those details, like Daryl Poe and his Pottstown franchise, aren’t disclosed in DonutNV Franchise Disclosure Documents. by Sean Kelly
(UnhappyFranchisee.Com) Edgar Allan Poe couldn’t have written a mystery more baffling than the DonutNV Franchise Disclosure Documents (FDDs).
FDDs are Federal Trade Commission-required documents intended to provide (among other things) a clear, factual overview of the recent performance of franchise systems like DonutNV.
However, DonutNV has failed to, or decided not to, disclose certain franchisees (like Daryl Poe, Mike Flowers, Rachelle & Thomas Hughes, John & Dana Owens) and certain franchises (Pottstown, PA, Panama City, FL, Clermont, FL & Ocala, FL).
There may be perfectly valid reasons for these lack of disclosures. We hope that DonutNV will clear up these and many other questions regarding their franchise disclosures.
Daryl Poe and the Pottstown PA Franchise Are Not Disclosed
On February 10, 2020, Alex & Amanda Gingold stated that Daryl Poe had become franchisee of DonutNV Pottstown. Yet the DonutNV Franchise Disclosure Documents (FDDs) do not seem to disclose Daryl Poe either as a franchisee or Pottstown as a franchise.

Daryl has been our corporate operations manager since 2016, operating our mobile truck fleet throughout the tri-state area, managing our Orlando, Florida store from 2016-2018 and most recently managing our Pottstown corporate store since opening in December 2018.
He is now the owner operator of Donut NV – Pottstown and we wish him continued donut success
On April 12, 2020, The Times Herald stated:
Gingold said the Pottstown location has a new franchisee running the business: Daryl Poe took over in Dec. 2019.
In 2024, Daryl Poe Was Interviewed as the DonutNV Franchisee of Pottstown, PA
January 30, 2024, the local newspaper published an interview with Daryl Poe (“In Downtown Pottstown, DonutNV Succeeds with Service”) and established his history as a DonutNV franchisee.
It states that Poe opened the 194 S. Hanover St., Pottstown, PA and supervised it as a corporate location:
“He later placed a bet on future success in Pottstown by taking the store under franchisee ownership in February 2020 (above). Next month he observes the fourth anniversary of that decision, one that’s paid off with praise from hundreds of patrons….
“Poe was only its second franchisee. The company now has dozens in more than 30 states.
“During more than five years in the borough Poe, separately and with other Pottstown businesses, has ensured DonutNV participates in local events. His trailer is found at a wide variety of functions in the borough and its municipal neighbors.
Curiously, Daryl Poe is Not Disclosed as a DonutNV Franchisee
Neither the 2022 FDD, 2023 FDD or the 2024 FDD lists an active or departed franchise for Pottstown, PA.
Neither the 2022 FDD, 2023 FDD or the 2024 FDD lists a current or recent franchisee named Daryl Poe.
None of the FDDs list Daryl Poe’s franchise as having been terminated, transferred or ceased operation for other reason.
Perhaps there’s a perfectly good explanation that Alex & Amanda Gingold can provide.
No Pottstown, PA Franchise is Disclosed in DonutNV FDDs
Despite the fact that Daryl Poe is identified as a franchisee operating both a brick-and-mortar location and an event trailer in Pottstown, PA, none of the FDDs we reviewed mentioned him or a Pottstown PA franchise.
The 2022 FDD states that it specifically excludes inclusion of brick-and-mortar locations, even if franchised:
“There are two DonutNV “brick-and-mortar” stores (in Pottstown, Pennsylvania, in “Clermont, Florida).”
and
“Outlets” refers only to a mobile trailer of type being offered to franchisees. It does not include the “brick-and-mortar” retail stores”
The Pottstown newspaper specifically mentions that he regularly operates “his” trailer at events:
His trailer is found at a wide variety of functions in the borough and its municipal neighbors.
The 2023 FDD states that its affiliate Keystone Amusements LLC operates a trailer in Pottstown and the store is franchisee-owned. The franchisee of the Clermont, FL brick & mortar store is disclosed, but not Daryl Poe. The DonutNV 2023 FDD states:
“Keystone Amusements LLC currently operates a DonutNV trailer based in Pottstown, Pennsylvania.”
and
“There are two DonutNV “brick-and-mortar” stores operated by franchisees in Pottstown, Pennsylvania, and in Clermont, Florida.”
The Franchisee of the Brick & Mortar Clermont FL Store is Disclosed But Not the Hughes Ownership Transfer
The 2024 DonutNV FDD lists franchisee Nenad Markovic as owning the Clermont, FL brick & mortar store:

However, the suspected December, 2023 transfer of the Clermont DonutNV franchise to Rachelle & Thomas Hughes is not disclosed.
It will be interesting to see if that franchise and its subsequent closure in 2024 will be disclosed in the April 31, 2024 FDD.
DonutNV is invited to explain why these franchisees do not appear to have been disclosed, and to correct omissions going forward in their new and subsequent franchise documents and filings.
