DonutNV:  Las Vegas School Principal Defends Deep-Fried Donut Decision

Yesterday, I posted an article about DonutNV’s aggressive selling of deep-fried donuts, sugary toppings and sugar-laden lemonade at Las Vegas schools during school hours.

I posted a schedule that included today’s visit to the James Billbray Elementary School from 2:30 – 4:00 pm.

James Billbray Elementary School Principal Altfas provided this explanation & justification:

Good morning,

Our school hosts NV Donuts outside of our main gates and does not sell to students within the instructional day.

They have recently started selling to parents waiting to pick up but we do not promote selling within the school day for any of our outside vendors.

The money our school receives as a donation from the vendor is utilized to fund student incentives and recognition items.

Clarification Sought From Clark County School District Officials

Ms. Altfas’s explanation & justification for raising money through the sale of prohibited, unhealthy snacks during school hours raises a number of questions that, perhaps, the school nutrition specialists at the CCSD and Nevada Department of Agriculture could address:

Ms. Altfas says they do “not sell to students within the instructional day” and “do not promote selling within the school day”

Would 2:30 –4:00 pm not be considered within the school day?

Ms. Altfas states: “Our school hosts NV Donuts outside of our main gates…”

Is it permissable to sell students prohibited products deemed unhealthy as long as you do it outside the school gates?

Ms. Altfas states:  “They have recently started selling to parents waiting to pick up…”

Is it acceptable to serve prohibited, unhealthy products to students as long as the parents purchase it for them?

    Venessa Altfas’s response is problematic in all 3 points:

    -It doesn’t matter if a vendor is located inside or outside of the “main gates.” The USDA Smart Snack guidelines expressly state that all property under a school’s jurisdiction is considered school grounds and any vendor on said grounds is responsible for ensuring that their products are in compliance.

    -The Smart Snack guidelines establish a “school day” as midnight until 30 minutes after dismissal/end of instruction. Per the James Billbray Elementary School website, dismissal occurs at 3:11pm, so Smart Snack compliance is in effect until 3:41pm. Per the online schedule posted by DonutNV Las Vegas, and confirmed by Principal Altfas, DonutNV serves a dramatically non-compliant product from 2:30-4:00pm, almost entirely within the “school day.”

    -Finally, Smart Snack guidelines do not apply to food purchased by parents for their children. HOWEVER, if products are ACCESSIBLE and ABLE
    TO BE PURCHASED BY STUDENTS (even a single student), then the Smart Snack guidelines must be adhered to. The fact of the matter is kids are able to walk up to the truck and purchase. I doubt anyone is turned away if a parent doesn’t present a valid ID. They may think this is a loophole, but it’s absolutely not.

    Clark County schools can argue all day that the concept is that parents can purchase snacks, should they choose to, outside of the main school area and outside of school hours, but literally none of that is remotely close to true or accurate.

    The disappointment is only exacerbated when you realize that the rate of children living in poverty in Clark County is notably higher than the national average; so are the overall poverty rate and the rate of students receiving free lunch.

    The sad part is schools and city’s do not care if this company breaks the rules because they are getting a cut. The truck near me is so gross. They constantly have young kids on the truck, touching everything, getting near the fryer. I even asked our local fire station the occupancy and they are breaking it. I don’t see how they pass health inspections both owners always look dirty, plus throw the kids in the back too. Unsanitary and should be some kind of violation. I also learned they have people on the truck they pay under the table and never got properly trained. A lot of these franchisees are breaking as many rules as the Gingolds. You feel bad for the ones who follow the rules and fail, but unfortunately it seems the ones who are successful are doing whatever they want. Donutnv and the schools are making money so why would they care?

    The fact that the principle seems to not care that they were lied to is concerning. They sent in a product they do not sell and it got approved. That right there should is a lie told to the school board. I wouldn’t be surprised if they Donut owners are related to someone in that school board if my the principal herself. It is sad that in this country we are already unhealthy and these schools are shoving sugar down kids throats. They know kids will want it when they see it and parents will buy it. It all comes down to money and greed at the expense of children’s health. I’m glad my children don’t go to school in that area. Makes you wonder if they’re okay with falsified information, what else are the kids at those schools subjected to. Kind of gross and I hope the right people see this and this company along with the school board gets exposed.
