Franchise attorney Jeff Haff recently commented on LinkedIn that there are prospective franchisees who think nothing of risking hundreds of thousands of dollars and their family’s financial futures on a franchise opportunity but balk at spending a few thousand dollars to have a franchisee attorney scrutinize the 10- or 15-year contract.

As every franchisee attorney knows, it’s extremely hard to get through to people who think they know what they don’t know.

Critical Secrets Are Hidden in the Franchise Disclosure Document (FDD).  Only Experts Know Where to Look.

It wasn’t until I dug into the Franchise Disclosure Document (FDD) of each franchise offering & could discern:

  • Two of these Mosquito franchise opportunities have 3-year franchisee turnover rates in the lower range for franchise companies I’ve reviewed (16% & 20%).
  • One of these mosquito franchise opportunities has a concerning turnover rate of 40% in just 3 years.  They had an average of 200 franchises open durning the period, and 88 franchises exited the system – one would assume having lost much or all of their investments.
  • Two mosquito franchises have alarming high 3-year franchisee turnover rates of 56% and 62%.

Digging in further, the one with the highest turnover rate has a 135% turnover rate for 2016-2023.

The franchise that describes itself as the “perfect opportunity for Veterans & First Responders” not only has the highest franchisee turnover, its  currently suing a 100% disabled Iraq War combat Veteran diagnosed with severe PTSD.

Trusting “Free” Franchise Consultants is the Most Expensive Mistake You’ll Ever Make

I did a deep dive on the franchise with the most failures.

I learned that nearly every one of their failed franchisees had been referred by “free” franchise consultants from such organizations as The Entrepreneur’s Source (TES), Franchise Broker’s Association (FBA) International Franchise Professionals Group (IFPG), and others.

These are “free “franchise consultants” in the same way car salesmen are “transportation consultants” and timeshare salesmen are “vacation consultants.”

Franchise Truth:  They are commissioned salespeople who will only recommend companies that have agreed to pay them commissions of $25K, $50K or more when you sign.

Once their commission is received, you will likely never see or hear from them again.

So before you enter the franchise minefield, plan on paying a grizzled franchise Veteran who will tell you the truth, and PAY a franchisee attorney (not your family attorney, not a franchisor attorney, not a prominent attorney with a different specialty) to review your FDD and FA BEFORE you sign.

Other than me and a few of my pals, FRANCHISEE attorneys are the only ones who both know where the land mines are hidden – and will tell you.

Franchise Truth & Franchise Truth for Veterans Initiative

The predatory JDog Junk Hauling franchise – which has resulted in over 300 Veteran franchise terminations – is just the tip of the iceberg.

There is currently no meaningful oversight or enforcement of franchise laws over the claims & representations franchise sellers tell trusting Veterans & other opportunity seekers.

Some of the most predatory franchise sellers are allowed to pass off high-failure rate  franchise investments as “Veteran-Friendly” franchises by virtue of their inclusion of deceptive “Best Franchises for Veterans” lists or endorsements by seemingly reputable organizations, like the International Franchise Association’s VetFran program.

Our initial analysis of more than 100 franchises currently promoted to Veterans through the VetFran program revealed that approximately 25% have 3-year franchisee turnover/attrition rates of more than 50%.

That indicates that a high percentage of Veterans being encouraged to invest in these “Veteran-Safe” franchise opportunities will not only lose their investments, savings, credit ratings, & perhaps their homes, some may lose the security clearances that gave them access to the good-paying government and contracting jobs they had prior to their franchise investment.
