We received the following franchise warning about the MATCO TOOLS franchise opportunity.  According to commenter “TOMMY CHEUNG” :

“STAY AWAY FROM MATCO TOOLS. THEY WILL SELL YOU A BILL OF GOODS,WHICH IS NO GOOD.

“RUMOR HAS IT ,MATCO MAKES MORE MONEY SIGNING NEW FRANCHISES THAN THEY DO TAKING CARE OF THEIR CURRENT ONES.

“DARYL PRITCHETT AND MIKE RAMEY WORK TOGETHER TO SIGN YOU UP AND THEN KICK YOU TO THE CURB. I AM WORKING ON A LAWSUIT AGAINST MATCO, HOPING TO TURN IT INTO A CLASS ACTION SUIT. YOU MAY CONTACT JERRY MARKS AT MARKS AND KLEIN LAW FIRM AT [redacted], IF YOU ARE INTERESTED.

“I INVESTED ALOT OF MONEY IN MATCO AND AFTER 3.5 YEARS THEY SHUT ME DOWN. WHEN THE ECONOMY SLOWED IN 2008,THEY PUT ME OUT OF BUSINESS.

“I ALSO SPOKE TO A PREVIOUS EXECUTIVE, WHO CALLED ME, AND STATED THATS THE WAY MATCO DOES BUSINESS. STAY AWAY FROM MATCO TOOLS AND RUN LIKE HELL WHEN YOU SEE THEM. I REPEAT DO NOT BUY OR INVEST IN MATCO TOOLS…”

Marks & Klein is a legitimate franchise law firm that often represents franchisees in lawsuits against their franchisors, but we haven’t verified with them whether a lawsuit against Matco Tools is in the works or not.

WHAT DO YOU THINK?  IS MATCO TOOLS A GOOD FRANCHISE OPPORTUNITY, A FAIR FRANCHISE OPPORTUNITY OR A FRANCHISE SCAM?

    ***********MATCO LIES – PART 3*****************
MATCO – HAS committed Franchise Fraud, they directly misrepresent and state
    “NO franchise fee”
IN FACT the “undisclosed franchise fees” lie in the:
    1. national purchase average requirement
    2. payment for freight charges to return warranty items
    3. and more…………

Getting close to 1500 posts – in just 4 weeks!!! (since 11/12)

That is almost 2 posts, EVERY HOUR, around the clock, at the time
of this post 1453 posts in 33 days = 43 posts a day!

    Countless, COUNTLESS others Reading!!!

Please, ask me how I know?

I receive multiple emails DAILY from current/former
DBRs, DMs, and others (some customers too)

    THIS much activity – WOW

I’m over the whole “I’m just here to stick up for DBRs trying
to make a living, or Matco is a good company.”

The conversation WOULD have withered and died out LONG
ago IF there wasn’t a problem! It certainly appears a lot of “background
noise” is being made so the TRUTH can’t be heard.

I am betting this IS THE MOST active discussion, with THE MOST
POSTS this site has seen EVER!

    ********Matco Lies Part 4*******

These are the lies that will really hurt the Company,
Fraudulent financing techniques thru SBA lenders –
There are testimonies and letters from people “on the inside”
proving this fact – probably the most serious of all the lies!
I am very interested and will follow this Court Case very closely!

Just doing my repo research again, I just found out in Texas and Kansas, you must be bonded and insured to do repo’s, as one guy in texas put it, without being insured to do repo’s, your days are coming to an end.

  • Tommy Cheung

you can call me the repo info-man, doing my research.

  • Former Distr

Junior’s comments about LOC modification highlights the problems Matco has, INCONSISTENT and UNFAIR PRACTICES.

I’ve been through 3 different DM’s and 3 different RM’s, ALL were asked to modify the LOC’s, not by just me but several Distributors in the District. Nothing was every done. Even when Matco had to survey 10 years later, they did nothing about modifying the route list. They listed in my calls several stops that were serviced by other distributors for YEARS. Let alone listing the same shops more than once, and shops that had closed 8 years earlier.

Again, all of the complaints about my district were sent all the way to the top, and nothing was ever done.

WHY would management support this kind of behavoir? It was just to difficult to change the agreement?

Many pro Matco comments on this list want to blame the ex-distributor for the problems encountered, I blame Matco upper management personnel for being ‘to lazy’ to properly train, monitor and control their employees. How could every distributor get a ‘fair’ deal, with so many inconsistencies across the country.

Ex. How many times would you have to call customer service, just to have a ‘particular person’ answer the phone and know that you’ll have to hang up and call again, if you want anything done.

  • Former Distr

With the inconsistency coming out of Matco Management Buyer Beware!

The DM that brought me on board was an excellent individual, and I trusted him. His replacement was a temporary one and also did everything within his power to make things right, though I now understand, he neglected to do many things ‘officially’, again I trusted him.

Then comes along the third DM, now we’re in trouble! The only thing he cared about was himself, no concern for the distributor. Never could make warranties right, could never assist the distributor on product defects, could never help with the bogus List of Calls or violations there of. It was always, “I can’t help you, sorry”, “Matco won’t let me do that”. Now I know that was BS, he just ddn’t care.

Moral of the story, if it isn’t right to begin with, DON’T SIGN! – because they will never make it ‘right’ later.

Admin wrote – “Junior, in a post that contained name-calling …expose Tommy for what he is.”

Junior – Thought I was rather consistant, seen a few personal attacks toward others, thought I could sneak one in. I’m rather creative, I can find other ways to insult without a personal attack. lol

Tommy wrote – “JUNIOR, YOU SAID YOU WERE LEAVING EARLIER,LEAVE………..”

Junior – Here is a perfect example of what you do Tommy. You think you read something, then later you truly believe you read it, then it turns into a fact in your world. I’m sure you’d like me to leave…you know what I know about your failure as a toolman. As you continue to hurt DBRs that are on the street today I will continue to share more about the FACTS of your relationship, your actions, and your words while you were supposed to be selling tools.

Tommy wrote – “How many legitimate questions have you avoided, MR. D.M.?”

Junior – Tommy you’re trying to paint me as an associate to Matco Tools. I’m an individual not related to Matco other than I happen to know the plan and I happen to know you didn’t follow it. So I stopped in to add a little balance to your arguement. Too I have a load of friends that are great DMs and DBRs and I am worried about the impact there future when non factual statements are posted.

Tommy wrote – “Junior, I thought we were buddies? … I am a hardazz,”

Junior – Ya, were buddies alright, and if you’re a hardazz why didn’t we see this while you were on the truck? The word I was thinking was hard-ly ever working. Too business questioning policy.

Tommy wrote – “Junior…lets go have a beer together … hows that sound buddy…”

Junior – The meeting. Sounds great, let’s arrange this right away buddy. Please.

Tommy wrote – “Junior, a D.M. OR D.A, you have never heard of a drop/add form ?You got to be kidding me, …”

Junior – DA? that’s as familiar as the drop/add form. Read my earlier answer very carefully Tommy. Comprehend what I wrote. It’s a proccess not a singular form. A DM does print the new LOC with changes and all parties sign it, maybe this is what we speak of, but it’s not a stand alone add/drop form.

Tommy, let’s work on that meeting. I accept your invite.

  • Tommy Cheung

Thanks buddy, I will be in touch soon.

ALOT OF QUESTIONS STILL GOING UNANSWERED.HMMMM

  • Todd A. Peterson

Just saw your post Matco1 and while I appreciate your ability to service 350 customers and still maintain your purchase average min. I have a few questions.

When you started your franchise were there Snap-On distributors that had been there for 10 yrs. servicing customers in your route that you competed with?

Or did you have a crappy Snap-On guy who was easy to steal customers from?

In my case, my main competitor was Snap-On. He won he Harley Davidson motorcycle and a BMW mini cooper from Snap-On for his sales excellence with them. Everybody loved him till the economy started going south and he couldn’t get the tools he needed to service his customers because of the money he owed Snap-On. So he files Bankruptcy. What happened next blew me away. My DM talks him into coming to Matco. I didn’t even think that was possible due to our franchise agreement but it happened. He became a District Manager down in San Antonio, TX for two years. I found this bizarre because I knew this guy pretty well and he even told me he hated being a manager for Snap-On.

So, why would a guy who sold Snap-On tools for over 15 years move away from the place he made his home town to go to San Antonio and do a job he hated?

Then why would he come back to service customers for Matco in the very route I was forced to vacate by the same Manager who hired him?

Why is this same Ex Snap-On distributor receiving perks from Matco to put a replacement Distributor in my route?

Why does this Ex Snap-On distributor have more customers on his route list than the previous two that failed before him?

That’s right his route now consists of what two failed distributors did plus a whole lot more.

  • Tommy Cheung

ITS CALLED OBC OR FAVORTISM CLUB, MATCO WANTED SOMEONE WITH CLASS , SO THEY HIRED A FORMER SNAPON GUY.

  • Tommy Cheung

Pyramid schemes are a criminal form of investment fraud in which a large return on a small amount of money is promised, if the initial investor convinces new recruits to invest their own money in turn. The “pyramid” is built on the belief that others will continue to add their own money into the scheme. But once additional investors become scarce, the pyramid collapses and large amounts of money can be lost. Increasingly, pyramid schemes are conducted via the Internet and e-mail.

SOUNDS SOMETHING LIKE MATCO, INVEST ALOT OF MONEY AND NOTHING IN RETURN. YOU CAN FIND THIS INFO ON http://WWW.FINDLAW.COM

  • MATCO#1

Former, yes to a snap on gut, 29 years in the same route, 2 others that have 8 plus years, Cornwell, Mac, and an independent I have a lot of competition, and it’s a ton of work, I don’t know what my competition has won if anything, I don’t care! I only care about me and my customers.

I don’t know the answer to your other questions.

  • Debbie Solko

Maybe, junior and Tommy should just “take it outside”

Junior is just provoking Tommy and has totally ignored the FACTs
They are not just facts Tommy has presented, but other posts are just
ignored- SO many good points presented
But junior brings the discussion down to a whole different level

    Repeat the problems
    Post the facts
    IGNORE the bullies

Lies – Matco HAS franchise fees albeit hidden and called by a different
    Name – NPA
    Matco’s route survey/mapping – complete joke
    – excessive windshield time, bogus mechanic counts, etc
Matco errors – on orders or credits…. And World Class Support boils down
to the DBR spending time and energy repeatedly calling
and Maybe getting answers or corrected order

In fact, recently I took a problem straight to Ernie Lauber
A letter received back almost 2 weeks later stated there was
No Record of my ordering (a toolbox and locker)
I Sent via Overnight Mail copies of the invoices
A tool box ordered, a locker both order same time

I’m still waiting for a reply……. Still waiting

I want a credit – Matco billed ME when I called to complain
the locker was sent and not keyed to match box

    Matco’s error – Customer’s frustration – my checkbook

    Still waiting

  • MATCO#1

Funny how some just throw statements on here with no actual facts, then call others names. How about some facts Tommy?

  • Junior

Tommy wrote – “Pyramid schemes are a criminal… pyramid schemes are conducted via the Internet and e-mail.”

Junior – You have proven NOTHING Tommy. You call this research? Go to court, or is your case too weak and based purely on opinions. What about you Tommy? Your stats as a dealer. You claimed you were in the top 200 but back then I never found that statement to be true either.

Back up your claims. So far all I see are little black words typed on forum/board that don’t carry weight until I read a court decision.

Debbie wrote – “Junior is just provoking Tommy”

Junior – Copy that Deb, Tommy has presented himself as wanting to protect DBRs yet all he has done over the years is hurt them. And now with his Craigslist campaign he is only hurting more of them. I’m here to expose this fact and counter his assault on hard working Americans. He can have his day in court, but to assault these dealers in their home towns is crossing the line. There is my beef.

Tommy wrote – “How can I contact you junior?”

Junior – You contacted me for at least two years while I was with Matco. I have you address, and your phone number. If you truly want to know me I will arrange it. But it will stay between us and its outcome is final. Do not take this as a threat, it’s business, you have harmed many good DBRs with your years of posts and court just doesn’t seem to interest you. Spewing your rhetoric in a misguided attempt to “get back at Matco”. You have harmed the good people not the ones you really hate. Matco can protect its self, the DBRs have to deal with what you have left them on the street. You could have stopped at stating your issues and filing a law suit, but no, you have gone too far. Your move Tommy.

  • Tommy Cheung

JUNIOR, we really are buddies, first of all ,I did not write the pyramid statement, I copied from a legal website. All I did was post it. Did it bother you? ********I AM A CURRENT DBR, I am certain to be out of business in the near future, not because of THIS site, or the TRUTHS that it has illuminated.

******NO, I AM BEING FORCED OUT OF BUSINESS – by Matco! **************

When a company, like Matco – systematically defrauds their distributors, the only result is business failure. I DID NOTHING WRONG, In fact, ask ANY ONE OF MY CUSTOMERS (from whom I have complete support ) I DID EVERYTHING RIGHT.
I WENT TO EVERY SHOP, I TOTED * I PROMOTED, I LEARNED (all on my own BTW) THE FEATURES AND BENEFITS, I KNOW MY STUFF.
I’VE GONE THE EXTRA MILE FOR CUSTOMERS
I’VE “MADE IT RIGHT” FOR CUSTOMERS – OUT OF MY OWN POCKET – WHEN MATCO (whom, according to You – can protect itself) That’s right, took care of customers when Matco failed.

I AM **NOT** THE ONLY ONE

I have the courage to speak up, to tell what it happening, to try to make things right. BUT, I can’t *wait* for some law suit or court to force Matco into action.
MY business, my personal family finances, are being threatened.

SO, IF THE **ONLY** MEANS AVAILABLE TO BRING ATTENTION TO THE PROBLEM IS THIS SITE, AND OTHERS LIKE IT, AND EVERY OTHER WEB PAGE WHAT WILL TAKE A POST………………….. so be it

    *Franchise Fraud
    *Distributor Churning

  • Junior

So Tommy it’s safe to say now, YOU 100% recognize you are damaging current distributors working their butts off to make a living in the tool business. Their families are impacted by your efforts where very little is hitting the very company you claim hurt you, and you could care less.

I will lurk, and when I see your false claims I will call you on ’em. Debbie was correct, I have taken this to a new level.

I know Tommy, I know Tommys real story as a dealer with Matco, and it’s not even close to what he claims.

    Lurking;

  • Tommy Cheung

Go Debbie, call it how you see it . We are all on the same page, and thats the page of deceit by matco. What about over INFLATED LOC, ILLEGAL REPO’S, SBA FRAUD,ACCORDING TO SOME THATS MADE UP, THE LIST GOES ON AND ON. What about selling someones belongings in their tool box , when it gets repoed. I was instructed by matco that it was ok.Its illegal.

  • Tommy Cheung

ALOT OF QUESTIONS GO UNANSWERED, WHY, CAUSE NO ONE WANTS TO ANSWER THEM.WHEN YOU SPEAK THE TRUTH, ITS GETS DEEP INTO SOMEONE AND THEY DON’T KNOW WHAT TO SAY.ILLEGAL REPO’S, SELLING PERSONAL TOOLS, AS INSTRUCTED BY MATCO,ITS OK, SBA FRAUD, MATCO HASN’T DONE ANYTHING WRONG,THEY ARE GOD, HEADCOUNTS MADEUP,I HAVE MY ROUTE SHEET,D.M SAYS HE WENT THERE, SPOKE TO MANAGER AND HE SAYS HE NEVER CAME BY AND IS WILLING TO TESTIFY. THAT IS FALSIFIED DOCUMENTS. ON AND ON AND ON.RUSHING PAPERWORK TO HURRY AND GET ME IN CLASS, WHAT IS THAT?

********QUESTION? – DOES MATCO CARE ABOUT IT’S *CUSTOMERS*??***

    *******************************NO*************************

Let me tell you why, and how I personally have documentation…………

***I audacity to attempt to form a Distributor Association***
MATCO was not happy, IN FACT – company wide email FROM TOM WILLIS was sent telling distributors NOT to talk to ME***************

Despite all the detractors – the intention WAS communication, and I was trying to IMPROVE my business – FOR MY CUSTOMERS – I needed answers to better serve my customers and conduct my business

But, I was blasted, labeled “disgruntled” – and a lot of other negatives………..

THE TRUE TRUE TRUE REASON TOM WILLIS NOTIFIED THE DISTRIBUTOR-
Matco DID NOT want THIS SITE’s information to be heard

NO NEGATIVE press was available on Matco

A GOOGLE search 2 months ago – PRODUCED NOTHING NEGATIVE

    Tom Willis feared communication,
    Communication = TRUTH

    The Truth is UGLY

SO – END RESULT – MY CUSTOMERS SUFFER

Tool box order, a $10,000 order – had SO many “mistakes” – 2 months later, I’m still trying to make it right, customer is NOT happy
(certain – the reason is Matco is NOT happy with ME)

This is not just MY opinion – THE MAJOR DEALERSHIP WHERE THIS TOOL BOX WAS SOLD – THE MANAGEMENT HAS STATED – AND WILL NOTIFY MATCO OF THIS-
THEY WILL NO LONGER DO BUSINESS WITH MATCO **IF** ** I ** AM NOT THEIR MATCO TOOL DISTRIBUTOR!!!!

We have the Matco police lurking, attention, attention, be on the lookout for the matco police.Matco is ruining the current distributors lives, families and security, because they are forcing us to complain. As another distr put it, Matco is destroying themselves.

Why is no one defending matco on the other page, the count has been at 78 all day? They must not have any supporters. It will take 3 months for them to get at 100. Would someone please step up and say something nice about matco or is there nothing nice to say? Hello, is there any supporters out there?

  • Bob Tremblay

After reading these post for a couple of days, I have found some very valid points on both sides. Most of the post seem to be about bashing each other that I don’t care to waste my time reading I will give the facts of my situation and leave it at that.

I will try to make a long story as short as possible. I became a Matco distributor in 2007. when seeding my route with my DM I found shops that were not on my list of calls a couple were not being serviced and he stated I could service them and he would add them to my list of calls. several other ones belonged to another Distributor.
when I finally got into my route I found out several of my shops here taken away from a couple other distributors. This did not make them happy and made it difficult for me to do business with them.
I also found out that my route was made up from a distributor that matco had terminated. he had 3 routes then downsized and went back to 1 route keeping the best shops. The portion of the route I received was the portion that he found to be unprofitable and wouldn’t service any more. Thats why Matco terminated him.
The DM I had was a former Snap-On Distributor and DM. I found him to be a poor business coach. There area I serviced were also part of my DM old territory with Snap-On. In fact on a ride along at one of my stops he informed me he would wait in my truck as the shop owner had threatened to kill him if he ever set foot in his shop again.

I had also found shops on my original list of calls that were no longer in business but were supposedly surveyed. how that happened is up to you to decide.

Just before the economic crunch hit my area hard. They put a new distributor in business and took shops away from me. My DM’s excuse was they weren’t on my list of calls. even though he was suppose to add them to it as he said he would do. He denies ever saying that to me. then tells me I had to any shops anyway.

Things went well the first year and a half then the economic down turn hit my area hard. shops laid off several went out of business. when I asked for help and more shops I was told I still had enough to be successful. When a distributor in a neighboring territory decided to close down. he gave me a list of shops that he had found that were not on his list of calls. when I went to service some of these shops my DM called me and forbid me to go to them they were not part of my route and were being used for the route for the new guy that was going to be taking over that area. Keep in mind I had to drive by all these shops at various time during the week to get to my stops from my house.

Long story short at the end of 2009 with the loss of customer base and and no help from Matco or my DM I decided cut my losses and close my business. When I contacted my DM he said that’s fine you weren’t working hard enough anyway and we’ll have someone else that will be successful within 6 months.

A couple of weeks ago I went to breakfast with a couple of the Distributors in my district and asked them if they had filled my route. They informed me that Matco determined the route wasn’t viable to sustain a distributor and split it up between the 2 distributors that bordered my territory.

Thanks to this website I will be contacting the attorney and becoming part of the class. I lost over 250,00.00 with Matco.

  • Debbie Solko

Thank you for posting Bob, I am sorry for your loss.
However, YOU stepping forward and sharing your story,
and seeking legal assistance – makes me feel good!

This all has been very difficult – I’m not here just to
cause trouble, and it certainly hasn’t been my idea of fun

But, I keep posting and the information spreads! Two years ago
I researched Matco and found nothing negative

Six months ago I had NO idea SO MANY others shared
my difficulties. In fact, when I questioned my DM about other
DBRs departures – he flat out LIED!
    ALL had been terminated!!!!
My DM painted some bogus tale about them all leaving
because of everything from personal/divorce to moving to just
    “change of heart”,,,,

So, again thank you for the post,

I totally respect the fact you stated your case and
want to stay out of the fray. I’m happy you found
the site and may be able to benefit from legal aid.

You can always email me personally. Contact info can
    be found at http://www.ladymatco.com

    Happy Holidays

  • Bob Tremblay

Thanks Debbie I just feel relieved that I’m not the only one who has had problems with matco. A good friend of mine is still a distributor and quite successful. but over the years he has seen the changes and is not happy with what he has seen , But he is a charter and has a different set of rules to follow and his territory is geographical and not list of calls.

The real interesting thing is is that in a 6 month span 50% of the distributors in my district closed up. I know a couple left for better business opportunities, a couple weren’t renewed and the rest just couldn’t make it anymore.

I do find it strange that Matco seems to hiring a lot of former Snap-On people for DM’s. As in the case of my district. My DM claims he left Snap-On because he made is money when Matco recruited him. But I have had Snap-on people tell me he was terminated. I probably will never know the truth and don’t really care anymore. I do lame him and my regional manager more than Matco. I think allot of what is going on is done behind upper managements back . I think the regional and DM’s and even the Business development managers, have found a way to make extra money through bonuses and commissions, by putting guys in business and knowing they will fail and then getting another one in. a DM gets a lot of commission on starter inventory and the recruiter gets a bonus for every one the get in.

  • Former Distr

This is a disturbing trend; my DM was also ex-snapon.

A good friend of mine has been reading the posts

    The observation was made…….

    On Dec. 14 12:10 am Matco #1 / guest #3 / Kevin Bergman wrote………

    I have 500 k in PSA…….Really

    On Dec. 16 12:08 am Matco #1 / quest 3 / Kevin Bergman wrote…..

    I only have 350 customers……..Really

So lets do some math, 500k div. by 350 is $1428.57 so if everyone of Matco # 1 customers has a PSA (doubtful) they owe $1428.57. If every PSA is a four year contract (doubtful) Matco #1 is collecting $2403.85 a week just to remit to Matco. That number is most likely much higher as they are probably not all four year contracts. Can you say contracting yourself out of business?

I don’t know, it is an interesting observation. Customers that have a PSA are pretty limited on what they can spend on their Truck Accounts
I would think it would be very difficult to support purchases meeting the NPA and collecting that much in PSA payments…………………..

Here is another story about preferential treatment of ex snap on dealers coming over to Matco.

There is a dealer in San Francisco that was with snap on for many years was recruited by Matco and GIVEN all of his inventory, over $80,000.00 in FREE inventory just to sign with Matco…How many of you new franchisee’s received this type of preferential (discrimination) treatment. And the manager that recruited and signed him, where did he come from? Good guess Snap On___
