    Matco is sneaking their franchisee recruitment ads onto employment sites like Careerbuilder and Indeed. Does this sound like an employment ad on Indeed?: “Matco Tools provides you with the guidance, training, potential customer base, marketing and the on-going support you need to start and run your business.”

    On your complaint, you should reference Section 5 of the FTC Act and Staff Advisory Opinion 06-1 (Below):

    ““…Section 5 of the FTC Act prohibits franchisors – and other business opportunity sellers – from engaging in deceptive practices in obtaining leads. Accordingly, a false offer of employment where no bona fide job exists that is made for the purpose of luring consumers into purchasing a franchise or other opportunity is a deceptive practice in violation of Section 5.”

    Kind of sad that Matco is targeting returning Veterans and the unemployed to try to land big initial tool purchases, isn’t it?

    It’s so funny Matco went from 827 routes on careerbuilder.com to 1,072 in the same day. This morning they were at 751 and now Debbie says they are at 747.

    If you go to Matco’s web site locater I posted 465 a few weeks ago and today they are at 560.

    Somebody doesn’t know their a*% from a hole in the ground do they.

    Blackandwhite, welcome to the discussion. Your ability to be so completely wrong in so few words is impressive. Where to start?

    Matco President Tim Gilmore states in his video that “a RECENT Deptartment of Commerce study showed that franchises have a 91% success rate over 7 years of franchises were still in business after 7 years versus just 20% of independent businesses.”

    1) In the document you link to, there is no author listed and no footnote to the supposed study. It is not the first few paragraphs of the DOC study as you (lied) stated.

    The SBA states it doesn’t vouch for that article’s accuracy. The article states that fewer than 5% of franchises closed between 1971 and 1987. That’s more than 20 years ago (not recent) has a different number than Gilmore states and makes no mention of independent businesses. If you want to do your research, provide a link to the ACTUAL study Gilmore quotes (hint: it doesn’t exist).

    2) Anyone with even a novice’s experience with statistical analysis knows Tim Gilmore’s claim is bogus just by its wording. It’s impossible to measure a “success rate” because success is a subjective term. A real study would involve how many businesses are open or closed, which is measurable, not “success” which is subjective.. (Duh)

    3) I did a little research (impressed, B&W?) and found info on this statistic on a site called Blue MauMau. It seems that the International Franchise Association has banned use of this and similar bogus statistics because they are A LIE. Here is the statement from the IFA telling its member NOT to use it:

    “Many years ago, the U.S. Department of Commerce conducted studies about franchising which presented such statistics. That information is no longer valid. The agency stopped conducting such studies in 1987. We strongly urge you to remove any information from your Web site and published materials that make such a claim. The use of such data, in the absence of current research, could mislead prospective franchisees who are attempting to conduct responsible investigations.”

    Matco Tools as IFA members would have gotten this memo but obviously chose to ignore it.

    4) Isn’t it blatantly deceptive to boast about franchising’s supposed 91% “success rate” when taxpayers have to pay back the banks on 37% of Matco’s SBA loans because its franchisees went belly up?

    Some thing’s are black and white, like Matco’s deceptive sales practices.

    so if franchises have a 91% success rate over 7 years and matco has a 37% failure rate over 3 years then that doesnt leave too much of a failure margin for all the other franchises. we just picked the wrong one based on being fed the wrong information by the wrong people.

  • Forty years in the trade and purchasing tools from Matco ,Snap-on, Mac and Cornwell dealers i can attest to one thing.The problem in all these distributerships is the district managers or trainers, they are commission base paid. they push and push the greenhorns to sell sell sell ( doesn’t matter if the person he is pushing you to sell to is 2 weeks into his job and might not last another day.) All that matters to him is getting your sales up so he profits. no risk to him of corse. So when you do fail and you will, you are than replaced and he can start the whole cycle over again.
    Simple fix do away with commission pay to dm’s. I saw this happen so often that i would warn the rookie dealers to watch they’re backs, and don’t let any one in management sell for them.

    I know many of you have wondered about the reasons for my Matco videos and why I’ve been so vocal.
    Matco IS guilty of unfair business practices and fraudulent franchise dealings.
    HUNDREDS of hard working distributors have been wrongfully terminated and their businesses and lives destroyed. No longer is a “lone disgruntled distributor” creating a flurry of activity. —–HUNDREDS OF STORIES OF TERMINATED FRANCHISEES,,,,, HUNDREDS!!!!!! ARE STANDING UP AND FIGHTING BACK.
    It takes courage to stand up to a bully. I’m finding it certainly isn’t the ‘popular’ position. However; change doesn’t happen on it’s own. Someone needed to champion this cause. Lady Matco has graciously accepted the challenge!

    What are the penalties for violating franchise laws?

    Governmental penalties for violating franchise laws can include fines, permanent bans on engaging in franchising, freezing of assets, money damages for victims, and even jail sentences. These penalties can be applied to the franchisor, and to its officers, directors, and managers who formulate, direct or control the franchisor’s activities. The violation of state franchise laws is typically treated under the statutes as either a fraudulent and deceptive trade practice, or a misdemeanor, or a felony. In some states, a franchisee who has been harmed by the franchisor’s conduct can be awarded money damages (including punitive damages and attorneys fees), or cancellation of the franchise agreement and reimbursement of all fees paid to the franchisor.

    Repurchase Obligations.

    In 10 states, the franchisor must repurchase some or all of the franchisee’s furnishings, equipment, inventory, supplies and other assets following the end of the franchise relationship. These states include: Arkansas, California, Connecticut, Hawaii, Illinois, Iowa, Michigan, North Dakota, Washington and Wisconsin. Most of these states allow the franchisor to offset any money the franchisee owes to the franchisor. In Arkansas and California, the repurchase obligation is only imposed in certain situation where the termination or non-renewal by the franchisor violates state law. In Connecticut, the law requires the franchisor to repurchase certain of the franchisee’s assets following any termination of the franchise, and in Hawaii and Washington, the repurchase obligation applies to terminations and non-renewals. The repurchase requirement is more limited in Illinois, Iowa, Michigan, North Dakota and Wisconsin.

    If you are a tech like I was 8 years ago I want you to ask yourself why so many Distributors start and quit their franchise with Matco. Then I would like for you to visit careerbuilders.com and see how many routes are available through Matco. Then type in Matco and Veterans into any search engine and see how they promote their Franchises to Vets coming from overseas. Then go to http://www.unhappyfranchisee.com and read more. Thank You.

    I understand Matco as I understand that violating FTC regulations involving promoting Franchises through Employment media’s as Employment jobs is wrong. SBA Loan fraud is wrong as well. Projecting false profits to obtain SBA loans is against UFOC agreement as well. Not to mention Falsifying Documents, Fraud, and Lying to Franchisee’s to Falsly Terminate them is also wrong. It seems that is the Matco Way Though. I promise not to link the unhappy franchisee site or the career builder site anymore as it is embarassing for your company and the readers of this site to see how low Matco has to stoop to get new Distributors to Churn and Burn.

    Let me make one thing clear! I am not PROMOTING any post. But yet a forum where the silenced have a voice to be heard. Where truth can be found and lies can be exposed. If you silence those who oppose you I am sure that only your voice will be heard as it was when I drove 14hrs. to Stow, OH to be dismissed by management. A letter put in front of me to sign and strip me of my right to due process. I will find ways to expose as I have with Tim Gilmore’s video. Career builder site. I am not done YET!     Matco makes their money on the hard work of others that think they will be able to work a certain area. However when that person builds up a good buisness Matco will take some of his customers and introduces a new franchisee. So it basically does you no good to do a great job trying to work your own buisness. Im sure thats not how they present it to their future suckers though! If you work for Matco I feel for you, and whatever you do dont work too hard or it will probablly cost you some of your route. Good luck!

    im not sure that i understand the careerbuilder site. it shows 3 routes in savannah. the only route open is my old route unless they put someone else ouy and divided his route. there is not much territory left to divide.

    I am glad to see people are also posting on matco tools facebook page.

    Matco has shut the obc club and they have disappeared, they must have been costing matco money, by not working and spending all day on here, Jason must be at the flamingo, with his boyfriend, Cary or Porkchop.

    If you are not an employee of matco, why is matco posting franchisess on a job board?

    Sect 5 of the FEDERAL TRADE COMMISSION states, franchises are not job opportunities, but businesses for sale, and can not be posted as job opprtunities.

    Could it be that all distributors really are employed by matco?

    Distributors, you should check that site out, you may find your route on there, because you are only a number and will be replaced.

    Yes!!! Matco has once again controlled me. Just like when they lied to me and told me I could be my own boss and own my own business they have removed my comments from their web site and disliked me. The truth hurts Matco and one day it will hurt even MORE.
