We received the following franchise warning about the MATCO TOOLS franchise opportunity.  According to commenter “TOMMY CHEUNG” :

“DARYL PRITCHETT AND MIKE RAMEY WORK TOGETHER TO SIGN YOU UP AND THEN KICK YOU TO THE CURB. I AM WORKING ON A LAWSUIT AGAINST MATCO, HOPING TO TURN IT INTO A CLASS ACTION SUIT. YOU MAY CONTACT JERRY MARKS AT MARKS AND KLEIN LAW FIRM AT [redacted], IF YOU ARE INTERESTED.

“I INVESTED ALOT OF MONEY IN MATCO AND AFTER 3.5 YEARS THEY SHUT ME DOWN. WHEN THE ECONOMY SLOWED IN 2008,THEY PUT ME OUT OF BUSINESS.

“I ALSO SPOKE TO A PREVIOUS EXECUTIVE, WHO CALLED ME, AND STATED THATS THE WAY MATCO DOES BUSINESS. STAY AWAY FROM MATCO TOOLS AND RUN LIKE HELL WHEN YOU SEE THEM. I REPEAT DO NOT BUY OR INVEST IN MATCO TOOLS…”

Marks & Klein is a legitimate franchise law firm that often represents franchisees in lawsuits against their franchisors, but we haven’t verified with them whether a lawsuit against Matco Tools is in the works or not.

    An advertorial is an advertisement in the form of an editorial or news story. Advertorials differ from traditional advertisements in that they are designed to look like the articles that appear in the publication. Most publications will not accept advertisements that look exactly like stories from the newspaper or magazine they are appearing in. The differences may be subtle, and disclaimers—such as the word “advertisement”—may or may not appear. The tone of the advertorials is usually closer to that of a press release than of an objective news story.

    The “stories” and interviews that have run in Professional Distributor CLEARLY fit this definition. While it is apparently not “illegal” it most certainly is misleading. However; that may SOON CHANGE. May 2011 The Federal Trade Commission (“FTC”) filed suit against 10 operators of advertorial websites that promote acai berry weight loss products. The websites are affiliate advertisers that earn commissions by steering consumers to a seller’s website where the consumer can purchase the products promoted on the affiliate’s site. The FTC alleges that these websites mislead consumers by posing as objective news outlets and failing to disclose the site’s financial connections with the sellers of the products featured in their “reports.”
    All of these sites use an “advertorial” format to promote the seller’s products. An advertorial is an advertisement that appears to be a news report. This is permissible if the financial incentives for the report are disclosed to consumers in a clear and conspicuous manner. But, the FTC alleges that these websites went too far and misled consumers by posing as objective, independent news outlets. In many instances the connection to the sellers were not disclosed, and when there were disclosures, the FTC alleges that the disclosures were inadequate.

    Clear bias can be gathered by the multitude of so called “interviews” printed in Professional Distributor. In addition, the “financial incentive” for Professional Distributor to print the multiply glowing reviews is not noted – nonetheless it only makes sense that Matco at a minimum “encourages” Professional Distributor to publish these “interviews”. Which only makes one wonder “WHAT FINANCIAL INCENTIVE” was provided.

    It seems that most news articles are driven towards influencing us rather than informing of us of something. This includes pretty much everything — articles on politics, consumer products, financial markets, global warming, and so forth. If advertising (and hence money) is driving these articles, are these articles just nothing more than disguised advertising? Of course they ARE!

    Deceptive Advertising
    According to advertising law, an advertisement is considered deceptive if it contains a statement or omits information that “is likely to mislead consumers acting reasonably under the circumstances; and is, ‘material’ – that is, important to a consumer’s decision to buy or use the product.“
    Essentially, the law states that your advertising cannot be misleading. You have to tell the truth, or clearly label your ads so that no reasonable person could mistake your intent. Advertisers [and their advertising agencies] need to have a reasonable basis for advertising claims before they are published.

    MATCO’S CLAIM OF WORLD CLASS TRAINING WAS ABSOLUTELY DECEPTIVE. IT MISLED ME………………

    Bait and Switch Tactics

    It’s illegal to advertise a product when you have no intention of selling that product at the advertised price. Bait and switch tactics are illegal, period. If you advertise a product, the law says that you have to intend to sell it as advertised.

    HOW MANY TIMES DID YOU RECEIVE THE BI WEEKLY FLYERS, WENT TO ORDER THE PRODUCT – WELL BEFORE THE FLYER GETS TO THE HANDS OF THE CUSTOMERS…………………….. AND THE PRODUCT WAS ALREADY SOLD OUT, ON BACK ORDER, OR OTHERWISE JUST NOT AVAILABLE

    THEN you give out the flyer, customer SEE the GREAT deal, and OF COURSE, you can’t get it……………………………

    I was just reading the Jobs.net ads for dealers and Franchisee’s near my area, Matco is advertising for new Franchisee’s where there are already existing Matco distributors with no room to split the routes…whats up with that??

    More terminations coming??

    Documents over 4000 angry comments. Matco Tools currently has a SBA LOAN FRAUD suit in federal court. They have been alleged of “churning” distributors and there are SEVERAL active lawsuits.
    Matco Tools has unfairly terminated successful distributors, sold NON viable routes to others and LET THEM FAIL – only to sell their routes again and watch the process repeat!
    Please check it out before you continue to ADVERTISE for this SCAM!

    and the jobs listed did NOT include distributors!

    You failed to mention the Matco dbr’s at the ISN expo have their travel/hotel expenses completely paid for by ISN, not like the Matco expo where the dbr will pay more than DOUBLE the listed room rates and DOUBLE occupancy and it is mandatory that you book through Matco and stay at their hotel or you are not allowed into expo…
    And to top it off the deals at expo are so meager that even many of the exhibitors are complaining about slow orders. Many of the exhibitors are not happy about how they are getting reamed by Matco to attend their expo.

    I can tell you from PERSONAL experience, the first Expo I attended,

    AT THE URGING OF MY DM, DESPITE THE FACT I HAD ONLY BEEN A DISTRIBUTOR FOR A FEW MONTHS

    I wondered then, how Expo was cost effective??

    After all, the “deals” SUCK – the pricing breaks were SO nominal my husband wanted to pass

    We decided to go, ONLY because WE wanted a vacation in Mexico :)

    Just read the “job” listings from”Jobs 2 Careers” and there are 33 available in tiny Rhode Island and over 700 out in California…These must actually be the number of terminated distributors over the last 5 years for those states, hilarious…

  • It’s interesting reading through these comments and you realize that the people that have lost their franchise misrepresent some of the things that they’ve recently found on the Internet.

    Debbie tonight finds a jobs website showing over 4k jobs using the keywords Matco Tools. Organized laughs that there are 33 jobs in Rhode Islands. Doesn’t take much effort to click on one of the state links and realize that the search includes any job description that uses the word ‘tool’. Hence there are jobs for Fidelity Investment included in that 33 jobs in RI.

    Todd has recently complained about tax credits given to hiring veterans, however he nevers states how Matco can use these for the veterans that would becomes franchisees. If you read the rules regarding the tax credit, they have to be on the payroll, not a franchisee.
