“DARYL PRITCHETT AND MIKE RAMEY WORK TOGETHER TO SIGN YOU UP AND THEN KICK YOU TO THE CURB. I AM WORKING ON A LAWSUIT AGAINST MATCO, HOPING TO TURN IT INTO A CLASS ACTION SUIT. YOU MAY CONTACT JERRY MARKS AT MARKS AND KLEIN LAW FIRM AT [redacted], IF YOU ARE INTERESTED.

“I INVESTED ALOT OF MONEY IN MATCO AND AFTER 3.5 YEARS THEY SHUT ME DOWN. WHEN THE ECONOMY SLOWED IN 2008,THEY PUT ME OUT OF BUSINESS.

Marks & Klein is a legitimate franchise law firm that often represents franchisees in lawsuits against their franchisors, but we haven’t verified with them whether a lawsuit against Matco Tools is in the works or not.

    This obviously isn’t “hate”. This appears to be a woman that invested in a business and wasn’t delivered what was promised. I just hope more people get the message. Matco Tools has an admitted 49% failure rate although, I am certain that was not part of their “sales pitch” They currently are being SUED for franchise fraud – “churning” distributors. Matco Tools knowingly sells NON viable routes and waits for the distributor to fail. NO World Class Service. So support, valid points presented.

    My personal responsibility lies with MATCO!!!

    Have you not seen the massive response to your stupid allegations that I have some sort of responsibility with my FRANCHISE FAILING???

    Lets see for the RECORD!

    Matco sold me a NON-VIABLE route to begin with! The previous Distributor was allowed to SELL me his route with LESS THAN $15,000 of inventory on it! Matco also let him SELL it to me only running it 3 days a week. I saw his FINANCIALS! He was only selling around $1700 per week. Why was a Distributor who was NOT in compliance with Matco regulations ALLOWED to SELL me a NON-VIABLE ROUTE TO BEGIN WITH????????????????????

    Then Matco comes to me ( TODD ALLEN PETERSON) after me creating a SUCCESSFUL Franchise (Something Matco didn’t start me with) and according to records I have had in excess of $240,000 my cost in Matco Tools and driving a 2006 Peterbilt tells me that I have VIOLATED MY FRANCHISE AGREEMENT! What I know now to be a LIE! Because the Distributor in question who was to start a Franchise WITH MY CUSTOMERS was not told he could have a Franchise through my DM but through the NEW REGIONAL MANAGER and a Texas DM. So when the Texas DM told me that Robert Tolbert my DM, who was FIRED by TIM NOVAK, had promised this new Distributor a route and he had quit his job and that Robert was fired for this reason was a LIE! Yeah, and the finger pointing at the fired DM as the guy who failed to secure the stops on my route list was ANOTHER LIE!

    But hey, the second time I was forced to give up shops was because I gave the NEW GUY JUNK SHOPS! ANOTHER LIE!!!

    When I got my new DM, who’s DADDY used to be a SNAP-ON District Manager for a guy by the name of Ernie Christmas who used to run a route for SNAP-ON in Memphis, TN., and he did nothing to help me with my route but add more shops to the New Distributor that had just assumed my customers and overlap streets that already had two Distributors on it. That is my FAULT as well???

    Then add in the fact that in 2009 I did everything but close my doors telling that same DM I needed a new route survey because of closed shops and low head count in which he PROMISED he would do so TWICE in 2009! That is my FAULT as well???

    As if enough things are my fault! I get a SEPARATION LETTER from Matco, without EVER receiving that ROUTE SURVEY on July 12, 2010, which says I am not at 80% of the National Average of Matco Distributors. NO SHIT! I asked for a route resurvey because of that VERY THING! I was told I would get it BUT I NEVER GOT IT! TILL I raised HELL about the Separation Letter and received a FALSE SURVEY by this same lying, fraudulent DM that’s DADDY is good friends with ERNIE CHRISTMAS! You think Ernie Christmas was happy with me purchasing MORE tools per week and OUTPERFORMING a SEASONED VETERAN of SNAP-ON and MATCO TOOLS in 2006? He has a territory as well as BUD COOK who was right next to me and brought on that new distributor who took my customers and my successful route! DO YOU KNOW WHO THEY HIRED TO PUT IN MICHAEL JOHNSON’S ROUTE? The very SNAP-ON dealer who got his start through his DADDY who retired as a SNAP-ON Distributor with truck and inventory. Then files bankruptcy in 2008 and within 6 months is hired as a DM by ANTHONY KRAMER and TIM NOVAK. Then put him right in the very route that two other Distributors had FAILED but gave him MORE SHOPS and a LARGER route! That is my fault as well???

    Not to mention I have the survey sheets performed during the HOSTILE TAKEOVER of my business by RICK PENA (DM from Texas which say I was doing a pretty DAMN GOOD job of making my customers happy with a 95+% Satisfaction Report! Not only that but I had TWO negative comments about service and one of them was NOT on my route list! FINALLY! Something that is MY FAULT!

    YOU KNOW I DON’T HAVE TO KEEP REPEATING MY STORY TO SOME J A WHO DON’T HAVE A FREAKING CLUE!!!!!!!!!

    I am WAITING for my day in COURT and it will be a VERY, VERY, VERY GOOD DAY!!!!!!!

    Okay I am tired of the everyone is out to get me story. One question what happened to the Las Vegas trip. Why on earth did you stock $240,000 at cost ? Sounds like your ego got the best of you. To bad your were chasing fame with a 95% satisfaction rate sounds like you were a good DBR. You should sell at least 4 times your stock for the year so using your $240,000 you should have sold $960,000 did you ? No you didn’t but you did spend your profits on inventory to buy a plaque great job. How is it working for you now ??????

    To anyone who is looking to buy a new tool box, now or in the future, DO NOT BUY ONE THROUGH MATCO!!! They DO NOT stand behind their merchandise. We have 2 of Matcos toolboxes at work, one is a Matco 6, 3 years old and the other is a 5 year old Harley Davidson box. Both very pricey, both inside at all time, and both bubbling and rusting to beat hell. They do not or will not do anything about this, just blamed it on us washing the floors at work. Which if they were sprayed with water undrestabdable but the floors ARE MOPPED!!! Thy just dont care about their customers just their pockets. Not that it matters but they lost 2 customers over not standing by their products

Matco makes products for a mechanic shop, they sell them to mechanics shop,they SHOULD hold up to the place the product are being sold to! If its not going to stand up to the environment its intended for, dont misrepresent it and say that its a good box!!! $7500.00 is alot of money to spend.

    I GREW my inventory to $240,00 my cost because I was servicing a LARGE customer base I CREATED! NOT MATCO! I was selling at MASS VOLUME! I was rolling my inventory! Go AHEAD! Tell me what a MORON I am to invest in my BUSINESS! Tell me I should not have bought those tools at EXPO! Tell me I overspent! You are such an IDIOT! If I only had the minimum amount to be a Distributor you would be telling me I was a FAILURE because I didn’t invest in my BUSINESS!

    DID I GO OUTSIDE MY ROUTE? NO!

    DID I HAVE THE APPROVAL OF MY DM? YES!

    DID I SELL OVER $450,000 dollars in 2006? YES!

    Would i have sold close to $600,000 dollars if Matco didn’t screw me out of MY CUSTOMERS in July of 2006? Absolutely! Probably MORE!!!

    Would I have made top 10 DISTRIBUTOR in 2006? YES!

    AM I TIRED OF ANSWERING THE QUESTIONS OF THE INTELLECTUALLY CHALLENGED? YES!

    Over the last 4 years of my Franchise did Matco screw me out of over $500,000?
    MINIMAL! NO DOUBT MORE!!!

    2006 (The Year of the Hostile Takeover) TOP 150 again ranked 134

    I think all of these stats straight from my DISTRIBUTOR STATEMENTS show the TRUTH.

    By the way, when I received that Separation Letter I only had about 154 customers left of the ones Matco had left me with after the HOSTILE TAKEOVER in July of 2006!!! My purchase average at that time was in EXCESS of $7,200.00 per week.

    This Last post of my financials paints a REAL GOOD picture of what CROOKED people in an immoral and unethical company can do to you IF YOU ARE SUCCESSFUL!

    No one, by the way, after my route was RAPED ever said ONE word to me about you need to do this or why are your numbers so bad or if you don’t do something about this we are going to have to TERMINATE. No EVALUATIONS, NO COMMUNICATION except for an EMAIL on January 10, 2010 my DM who has NEVER sent me an EMAIL to communicate anything other than meetings and phone contact lists sends me a letter stating I was not at 80% of the National Average in 2009 which I did not find because he never mentioned it. I only found it when I was terminated because I was trying to organize and had time to email people.

    Now, doesn’t it seem ironic that a DM who had told me twice in 2009 he WOULD resurvey my route sends me the SET UP email instead of calling me to discuss WHY I am not at 80% of the NA? Why is it you think he sent me an email for something that is as important to discuss as violating my contractual obligations? Is it because he knew I knew I wasn’t at 80% of the NA? Is it because he felt GUILTY about NOT RESURVEYING MY ROUTE? Or is it because he was TOLD by SOMEONE ELSE to send me this type of COMMUNICATION instead of doing what a DM is supposed to do SUPPORT the DISTRIBUTOR?

    I sincerely hope the Hawaii crew can make a go of this however the sad statistics show that no dealer has ever made it there…EVER!!

    The tool routes in the islands are among the toughest in the US to make a living due to demographics and geographic location

    So keep God in your pocket because thats all you will have left when Matco is finished with you all…

    Sunny has not been with Matco for quite awhile, so what else ya’ got…how about the other 30 or so MATCO distributors that have come and gone over the years in the islands…does Matco spin that kind of success rate as 100% positive.

    The reality of it is Matco has 100% failed the Franchisees in Hawaii and the failure rate is close to 100% for Matco Franchisees in Hawaii

    Matter of fact Matco has previously admitted to actually losing money on the Franchisees in the islands…Until they perfected the “Churn N Burn” strategy

    Matco Tools is BAD business. They are the subject of multiple lawsuits. They have been accused of SBA Loan Fraud and Distributor Churning. They knowingly sell NON viable routes. When the distributor fails, Matco Tools re sells the same NON viable route again. They violate US Labor Laws and distributors routinely perform labor for which they are not compensated. Matco Tools also violates FTC regulations by advertising their franchises as actual JOBS on several Internet employment sites.

    lady matco you saved me from being one who would have been one of the failed if i had not found out about the unhappy page and talked with other dealers around the country about how bad it is my money would be GONE WITH THE WIND matco even called me back and offered a 6 month free run at it to try to get me in. all i can say to you is thank you for being honest with me and to others who are thinking of getting in use the discloser info and call dealers around the country li8ke i did and the story is all the same i was told don’t do it you will lose everything the sad thing is i like the tools always did well for on my job

    Franchisees Allege Fraud in Matco Tools, TD Bank Class Action

    New York, NY: A fraud class action lawsuit has been filed against Franchisor Matco Tools and TD Bank, by franchisees who allege that the tool company misrepresented the financial opportunities available to potential Matco Franchisees which resulted in business failures and small business loan defaults.

    The lawsuit, filed by David Villano III and his father, David Villano, Jr., alleges that Matco Tools and TD Bank (Commerce Bank at the time—TD Bank has since acquired Commerce) conspired to make Matco Tools franchise opportunities appear better than they really are. According to the lawsuit, the idea was that by inflating the appearance of Matco’s annual performance projections, lenders would approve small business loans, allowing the sale of the franchise to the franchisee.

    The lawsuit further claims that the soon-to-be-franchisees weren’t shown those inflated projections. While the franchisees did receive their loans, the franchises was destined to fail, the lawsuit claims, and the money never should have been lent in the first place.

    According to a recent article in the New York Post, loans to Matco franchisees had a default rate of 37 percent in 2004. That compares to an eleven-year average Small Business Administration (SBA) loan default rate of 11.64% according to a study done by the Coleman Report.

    why is it that when you go to stow for your initial indoctrination, brain wash, do they infer that they have their own tool line that is better than anyone elses. they are constantly testing the competitiion against their own.
    they dont have their own tool line. so they must be testing the different manufacturers to see who they want to cuddle up to to put their name on an already established product so that they can sell it to all the dbrs at an inflated price claiming it as their own.
    is this deceitful, yes it is and only the beginning of the end for alot of us.
    they do not have anything close to the other tool companies as far as marketing their own name branded tools. they mark up an already established product and advertise it as their own at a very inflated price, marked up for sale to us and then for us to sale to the end user. people are not as stupid as matco thinks anymore. the internet has fixed alot of that. google, google ,google.

    why is it that when you first go out of business some of your skips might show up but after a few months none of them will show up. even the ones that still had a balance on previous exposure.
    i know why. matco does not care about who may still owe you. all they care about is what the next dbr can sell to anyone, whether they can pay for it or not unless it is a psa, then they have the final say so. they dont want the next dbr trying to collect your money when he can be selling more tools and increasing his skips percentage to increase the profits at matco.

    sound familiar. its a fact jack.
    anyone even considering buying a matco franchise should go slam their head in a door and see if they would want to do it again. both answeres should be NO. NO. NO.

    anyone that thinks that all the negative comments here are by a bunch of losers and or failures should look really hard here, because you could be one of us really quick with little or no effort on your part.

    matco will take care of that real quick with their world wide support. they win , you lose, works every time for them.

    why is it every time matco makes an accounting mistake it is always in their best interest and is never caught unless you scrutinize every charge and credit that you are charged for. how many times have you been given credit for something that you shouldnt have, none. their math only works one way and it up to you to catch the mistake and proove it wrong.
    i have been charged thousands of dollars for payments that i have receipts for but they cant seem to figure it out , yet it is all done on their system that they control.
