• Guest: I really believed that was a win/win for you as well! I mean just being in my general space/area should be enough to warrant what is proposed.

  Now in regards to the “law”, I am sure that you didn’t mean to imply that Overhauser/Jack/Plaintiffs should get special treatment, that the laws are somehow different for them than for someone such as me/Shamrock/Stratus, correct? I mean in my last depostion, I was under oath, I had to answer residency and citizenship questions, as well as every question posed to me under the penalty of perjury. Surely (Yes, I did call you Shirley!) you cannot mean that Plaintiffs have special rights, special authorities, special rules in a court of law?

  You are correct, that if it hadn’t been for the lies, false statements, meaningless guarantees that Mz. Jack’s “partner” bestowed upon the Plaintiffs, I am sure that they wouldn’t have been party to this bogus lawsuit…..Many a Plaintiff in a Wal-Mart slip/fall has gone by the wayside before, many will follow. There is a real reason that ambulance chasers equal attorney’s. However, Overhauser/Jack have taken that to a new level for sure.

  I honestly feel sorry for the majority of the Plaintiffs and would be happy to assist them anyway possible when they find another attorney and sue Overhauser/Jack for Malpractice.

• @Viewers: “BRO” has confirmed that nearly none of the Plaintiffs listed in the bogus lawsuit filed on their behalf, by Overhauser/Jack are willing to give Depositions and/or testify. Now, what does that say about not only the attorney’s involved in this case, but the Plaintiffs? I mean, here you say literally anything you want, not forced to back it up prior to filing the lawsuit, then when you cannot get a “technical default” you are unwilling to “put your name on it” by simply adhering to the rules that everyone else has to play by. Now of course, Overhauser/Jack will state that they had NO IDEA that Plaintiffs were unwilling to subject themselves to simple depositions, but it does make one wonder why they were wanting/working so hard to get a technical default, doesn’t it?

  So, in a nutshell, we have a “cut/pasted case”, filed by a patent attorney and woman’s issue attorney, on behalf of Plaintiff’s that were at best misled and at worst coerced into being party to this lawsuit, sold by a “mystery person” that has ties directly to Mz. Jack that knows/understands Spanish w/o slang words, making false/impeachable statements and unwilling to back those statements up by being party too a simple deposition……Throw in a former disgruntled/poor performing employee that has told numerous lies, breached his employment contract, posted lies on this site, contacted Stratus customers, contacted Stratus owner-operators, made knowingly false statements and now wants to be friends again and doesn’t want to be sued (too late for that), you have a cast of liars, clowns and attorneys that should know better!

  And Yet, this disgusting/bogus/lie filled/sham of a lawsuit continues……Now viewers, the question posed to you, this is exactly what happens when you refuse to fight non-sense such as this lawsuit, once we win, we will be able to dance a little, be able to show people that we were right and the accusations made against us were so false, that Plaintiffs were unwilling to even show up for basic depostions, that attorneys were so unethical in the filing and handling of this case that they gave ambulence chasing personal injury attorneys a bad name!

  “BRO” has learned some interesting things over the last day or so in regards to the Plaintiffs/attorneys……As depositions are being scheduled, as lawsuit is being prepared against Bob P., aka Lies be told, tell the truth, anonymous Indy/Rex, there is more information coming that at least one of the Defendents will be filing a countersuit against all Plaintiffs regardless of outcome as he has been described as a “walking liability”…..

  “BRO” has also uncovered that many of the Plaintiffs did not report their earnings generated from Shamrock/Stratus, in at least one case for a period of three (3) Years! Some of the Plaintiffs filed NO tax returns at all!

  “BRO” has also uncovered that in at least one case, there appears to be an issue with the assigned ITIN number not matching actual Plaintiff?

  Doesn’t it make you wonder that if Plaintiffs didn’t file tax returns, didn’t report income properly, may have committed fraud in regards to ITIN documentation, what else they may have lied about? It should also make you wonder about Overhauser/Jack what they did know, what they didn’t know, what they did ask, what they didn’t ask and the reasons why?

  Interesting revelations for sure………More investigations and results sooner than later!

• Lawsuit against me for breach? I was discharged ILLEGALLY , according to the State of Indiana. Unemployment also found no fault with me when challenged by Stratus. Go ahead. Have at it. The only lies on here are being told by Jerry W. aka Hefty Bag. It’s such a shame. Friends? I recently had a text from Mr. Wenger directing me to contact the owner of Stratus Indy, that he may be willing to give me a job back. Why in the world would I do that at this point? I seem to be getting the blame for everything, I guess when you don’t accept responsibility for your own screw ups, you have to find someone else to blame it on.

  Do you have any basis for your statement that a lawsuit is being prepared against Bob P. or do you just make things up as part of your lame bullying/intimidation tactics?

  As you supposedly have a HS diploma and an impressive Associates degree from some college I’ve never heard of (as I don’t smoke, I don’t read a lot of matchbook covers) and your grasp of the law is obviously superior to those who wasted their time going to actual law schools, passing the bar, and practicing law, you are no doubt aware of the legal term for making up negative things about people and stating them as fact.

  For those who don’t share Hefty Bag / Bill Falkner’s impressive education and legal credentials, that term is “libel.” I’m sure Mr. Falkner is making sure that everything he has stated as fact here he can substatiate as fact. Otherwise, Ms. Jack and Mr. Overhauser may have the pleasure of dragging Hefty Windbag into court for a defamation case.

  I’m sure they would try the case “pro bono” (a Latin term meaning “for the fun of it”).

  And I’m sure that Stratus will gladly pick up his legal bill in return for his devoted service and defending its honor here with his witty and erudite defense of this arguably criminal enterprise.

• @Guest: Oh how I love the smell of FEAR! It’s almost like in that movie Platoon where Richard Duval (shirtless) walks onto the beach and declares “I love the smell of Napalm in the morning”! That’s what I smell coming from you, Overhauser/Jack, Plaintiffs and Bob P. I mean how stupid do you think I am? (can hardly wait to see what he posts after that open ended question) I mean even a simpleton like me knows that in order for something to be “libel” that what is being said must be a HUGE LIE!

  Problem for Plaintiffs all along, have been the lies, the false allegations, the impeachable statements that THEY (through the translator/Mz. Jack’s Partner/doesn’t know SLANG words in Spanish) made all throughout their BOGUS/SHAM/Lie Filled LAWSUIT. Now, it is also amazing for someone as supposidly smart/educated/upper crest that you pretend to be in your old, run down, beater of a Mercedes, that when someone AGREES with you and your friends (Overhauser/Jack) false statements, well the are Heros, they are protecting their legal rights, they have the 1st Amendment (no no that one, the real one) for protection. Yet, those that disagree with you, have a differing point, are simply spouting facts upon facts, offering real items of discussion, well they are threatened, they are called names, they are simply desired to be SILENCED!

  So, since I don’t scare too easy, since I like seeing you Sweat, since I like seeing Overhauser shake, since I like watching Mz. Jack frumple, since I like listening to Bob P. with his MPD justify the stupidity by which he lives each day in, I guess its time for some PREDICTIONS……..

  a) As the Plaintiffs are busily running off the sinking ship known as this Bogus/Sham/Cut and Pasted Lawsuit, they will NEVER show up for depositions, they will never fill out/answer their interrogatories, they will never bring the documents requested in the Supeona Duces Tecum. They will simply attempt to fade into the darkness and hope/pray that Defendents decide not to pursue them legally.

  b) As the Plaintiffs confirm their unwillingness/inability to continue the pursuit of this Bogus/Sham/Cut and Pasted Lawsuit, Overhauser/Jack are left with no other option than to remove themselves and withdraw this suit from the court and again hope/pray that Defendents decide to leave them alone and not ask for Sanctions, make additonal mockery statements against them and find out/confirm the identity of the person that did the translating and communication/solicitation of the Plaintiffs in the first place.

  c) Overhauser will remove Mz. Jack from his Law Firm.

  d) Overhauser will stick to the area of the Law that he knows best, Paper Pushing.

  e) You (Guest), will simply crawl back into that little hole from which you came and hope that you don’t have to face me again in the Blogosphere!

  f) Bob P. w/ MPD will be sued, if for no other reason than to remember that no one likes him.

  Let’s see how many of the above Predictions are correct, it won’t take long, many have already begun coming true……

  If I had made my living secretly taking advantage of honest, hardworking people, like he allegedly does, and the rock I operated under was suddenly lifted, exposing me and my misdeeds to the light of day, I guess I’d be pretty desperate too.

  Soon, there will be meetings taking place with all 50 owner-operators that chose NOT to join this lawsuit, the HARM that these 9 have done, the HARM that Overhauser/Jack have done, the HARM that Bob P. have done, will be fully revealed to them and the mode by which they can get back at them. How is it fair that 50 owner-operators and their families get to be HARMED by 9 lazy, good for nothing, lying, sacks of crap? How is it fair that an ambulance chasing, pond scumming, egg sucking, immoral and unethical officer of the court (supposidly) Overhauser/Jack are allowed to HARM so many? How is it fair that a low-life, terrible performer, out of work, terminated for cause former employee is allowed to HARM so many?

  On Monday, there will be some HUGE announcements including more details about the identity and powers of Sumo!

  If I were Nydia Martinez, Maria Mannriquez/Jose Matafasio, Yolanda Alvarez/Jose Leon, Lorenzo Rodriquez, Faustina Negrote, Elsa de la Cruz, Victor Garcia/Laura Andalon, Teresa Escobar and Ronny Funez, I think I would all be at Overhausers Office on Monday a.m. and recanting and forcing Overhauser/Jack to remove your names from the lawsuit. Just a piece of friendly advice.

  If I were Overhauser/Jack, I think I would have Security Guard at my office. Probably should be armed, I’m just saying, you never know what a group of people may do when they find out that they just lost tens of thousands of dollars and it was all due to Lazy, un-caring, liars, cheats and thieves such as the Plaintiffs. Due to a bunch of washed up/has beens/cowards such as Bob P., Fred G. and Olivia G. and to a couple of unethical, careless, ambulance chasing attorneys! In one corner/side you have Sumo, The En Quiebra (lucha libre) and The Amercian Dream, Dusty Rhodes (Me) or my second favorite The Dirtiest Player in the Game, Rick Flair vs. The Ambulance Chasers (Overhauser/Jack) and Merle (Bob P., anonymous Indy, anonymous Rex, Truth be Told, Tell the Truth)

  You may ask, Why aren’t the Plaintiffs listed? Because they are done, they aren’t getting one penny, they got their 15 minutes of fame and the 50 Owner-Operators that just got screwed by them will finish their envolvement in this sham/bogus/lie filled case.

  There are many ways to “end a case”, sometimes you do it thru the court system, sometimes you do it in the “court of public opinion”, sometimes you do it by smoke/mirrors, sometimes you do it by changing the arena by which the case is fought.

  Come Monday, all of the above will finally begin to fall into place. For Guest and Guest Too, here are the final predictions for the major players.

  Bob P. will get nothing, his 15 minutes of fame are done, he will need to move not only because of the 50 People, but basically he needs a major change of venue because his “light” is so bright, it can’t handle the coming darkness.

  Olivia G., Fred G. and two others to be revealed next week, they are done, not only because of the 50 People coming to seek them out, but because I am going to make it my personal goal to make sure that they don’t see the business “light of day” ever again.

• @ Guest Too: I read an article that an attorney proudly placed on his blog, that attorney’s name is Jonathan Fortman. Possibly you should read the article sometime, it talks about how he and a well placed employee of Stratus Franchising brought down the entire company by utilizing social media such as this. Figured if it worked for him/well placed employee of Stratus Franchising, why not others? Funny isn’t it, when one side uses social media for its purposes, it is considered “leveling of the playing field”. when another side uses it, it is “mean spirited”, “threatening”, “disgusting”, “lie filled” etc…etc….etc…

• @Viewers/Guest/Guest Too/Bob P.: The second round of meetings happen today with the largest and therefore most at stake owner-operators. The harm that has been done to these people is REAL! Literally 100k that should be rightfully going to them in the next couple of days, simply isn’t there to give. 50 owner-operators, their families, their employee’s have been harmed. These are the 50 vs. the 9 that chose NOT to join this bogus/lie filled/sham of a lawsuit, These are 50 that have REAL Dollars of harm done to them, that HARM lies directly at the feet of Paul Overhauser, Katherine Jack, Plaintiffs, Bob P. and others without a doubt.

  At the end of the day, whether the company as a whole survives or not, does not matter financially to me one bit. It doesn’t hurt me, my lifestyle, my family as I did not share in the risk, therefore I got none of the reward. But my heart aches for these 50 and their families, their employee’s and their families, none the less. My heart is very hard and cold when it comes to innocent people and their families getting harmed thru no fault of their own.

  Paul Overhauser and Katherine Jack, I hope you have more trouble sleeping the next few days, (Obviously I am) I hope Plaintiffs have a hard time sleeping, Bob P. won’t have a hard time sleeping as he will simply take a “hit” or a pill. Over the long holiday weekend, I spoke with not less than four (4) attorney’s, all with as pretty if not prettier pieces of paper than Mz. Jack and Paul Overhauser, I sent them an email copy of the lawsuit, emailed them a copy of the FDD,gave them an overview of the nearly 600 pages of documentation given to Plaintiffs attorneys (400 plus before subpeona) and allowed them to ask me basic questions. Now granted for the record, NONE were patent attorneys and NONE handled/specialized in Woman’s issues…….But NONE of them would have taken, nor moved forward on this “cause” for a variety of reasons, ONE would have at least contacted the company, asked for documentation to refute the Plaintiffs accusations but based upon the information supplied, would not have moved forward with this cause, even if Plaintffs wanted to pay him in full vs. on contingency. The only reason that I bring this up, it fits with the two other attorneys that contacted us in the past about supposed issues with Jose Leon/Yolanda Alvarez and Ronny Funez respectfully.

  Overhauser and Jack are low lifes without a doubt, even while they have been notified of a pending change in the case, even though they have learned that NO insurance policy will be available for them to get paid EVEN IF they win, even though they have learned that financially, even in the best of times, the company in question made less than 40k profit in one year and even though they have been shown nearly 98% of all documents requested, they still move forward with this bogus/lie filled/sham/impeachable lawsuit.

  Now they have been notified, soon it will be verified for them, that THEY have caused nearly 100k in REAL HARM to 50 owner-operators, their families, their employees and their families, it is my guess that they will still continue. It is lawyers like them, that give attorneys bad names.

  A business owner is one who performs services for a client and receives money from that client. What do you call it when someone performs services for a client, the client pays a third party and that third party only pays the one who performed the work if and when they feel like paying them? That third party has the ability to withhold $100K and use the insidious excuse that they’ve got legal expenses to NOT pay the worker the money given to them for the worker’s services rendered?

  Who would call that worker a business owner? Indentured servant, maybe. Slave, maybe. Scam or Fraud Victim, likely. OWNED-Operator, for sure. But a business owner? No way!

  This type of fraud and coercion is exactly why service workers in this country need strong union representation. Forced Labor and predators bypassing employment laws through sleight-of-hand and wordplay by companies like Stratus Indy aka Service Cube need to be stopped, and individuals need collective bargaining and representation to stop the exploitation.

  How much of a pay cut did you take in order to contribute to the JUST CAUSE? How much blood are you putting on to help these poor damaged Owned Franchisees? A person as magnanimous as financially secure as yourself out to be able to SACRIFICE HIS SALARY to help the poor HARMED franchise’s, shouldn’t he? What is it besides name calling and threats to people are you doing for these poor dedicated and loyal slaves?

  There were 50 owner-operators harmed, without a doubt, there are many people who HARMED them, without a doubt. Who’s willing to stand up for them? Who’s willing to tell the truth? Is Overhauser/Jack? Is Bob P., Fred G., Olivia G.? How about you? Pay someone “off” for telling lies, Pay someone “off” for causing harm, Pay someone “off” for making false allegations?

  You’re right, it would have been cheaper, NEWS FLASH, it wasn’t offered by Plaintifs, nor their attorneys EVER! But it wouldn’t have been accepted anyway.

  All financial documents of Shamrock/Stratus are part of the public record for the last four years.   How about this idea, Overhauser/Jack instead of getting sued by the 50 owner-operators just simply send each of them a check for the amounts they didn’t get paid?

• I just want to be clear, so correct me if I’m wrong: Scamrock aka Stratus Indy aka Service Cube is withholding $100,000 in payments rightfully due to 50 franchisees.

  These franchisees paid upfront for guaranteed janitorial jobs. They performed the work. And Scamrock aka Stratus Indy aka Service Cube is refusing to pay them. So the 50 franchisees are out both the upfront money that they paid, the amount they are due for the work they performed, and also the “opportunity costs” of what they could have made if they spent their time at a company that pays their workers, like McDonalds.

  Is this correct? And SHAMrock aka Stratus Indy aka Service Cube can find the money to pay their executives / defendants, including Probably Jerry Wenger, who not only paid nothing upfront but got the company sued, but they can’t find the money to pay the 50 franchisees their OWN money?

  The $100,000 is the franchisee’s money, pure and simple. Legal bills are corporate costs that have NOTHING do with the franchisees. Blaming the Plaintiffs for Service Cube not paying the 50 franchisees is like blaming the landlord for the office rent, blaming the electric company for their electrical expenses, blaming the auto industry for their car lease payments. Shamrock aka Stratus Indy aka Service Cube is, IMHO, simply taking the franchisees money and doing with it what they will… and that’s not legal.

  Hefty Bag aka Probably Jerry Wenger is avoiding this point: If Shamrock aka Stratus Indy aka Service Cube doesn’t have the franchisee’s $100,000, they don’t have the money to pay him and the other defendants. It would seem logical that there should be IMMEDIATE layoffs and the Defendants should be forced to pay back the salaries, commissions and bonuses that were paid to them, either directly or indirectly, out of the $100,000 that was stolen from the 50 franchisees.

  Have I got this right? Does this make sense?

  Now, you say Stratus revenue is public record, and you must have made it successful, YOU, right? You brag it up, yet you can’t pay Fred G for work already done at your request?   Do you know there is no cap on a libel suit that is brought against someone in Superior Court? There has been a couple in the news here recently that can serve as precedent. Those suits can be filed against an individual…Probably Jerry Wenger.

  You think you are so slick. What if…there is more known than meets the eye? Waiting to be revealed. I mean would you be so underhanded as to use others family members to glean negative information on people you see as a threat? Offering gifts even? Just curious. • @Guest Too: Sorry, I maybe a little arrogant, without a doubt. But the Truth is as follows:

  1) Overhauser/Jack contacted the potential plaintiffs or at least someone in their office did. Some of these people (that chose willingly NOT to join this bogus, lie filled, sham of a lawsuit) were contacted to the point that they were yelling at the person calling ” don’t f****in call me anymore! (direct quote)

  2) Plaintiffs (9) decided to listen to what Overhauser/Jack were “selling” and made false allegations, false statements, impeachable statements at the very least. They called the owner (only shareholder), the company (not Stratus Franchsing, but Stratus of Indiana) and its management team literally everything under the sun including forming a modern day “slave pool”. Now it has been suggested more than once, that Kevin/Shamrock/Jerry Wenger/Pamella Martins should have “paid Plaintiffs off”! Are you kidding me?

  3) Overhauser/Jack were given over 400 pages of documentation proving over 98% of all allegations made against Spellacy/Martins/Wenger/Shamrock were false and/or at best mis-stated. BEFORE any actual court proceedings, BEFORE any Subpeona’s had been issued.

  4) It is a well known fact that WENGER, without attorney, sat and was deposed for over 4 hours answering ALL questions posed to hime, without taking the “5th” once.

  5) Through various legal manuvers by Overhauser/Jack an additional 200 pages of documentation including ALL insurance policies, ALL financial statements, ALL tax returns for Shamrock/Spellacy were turned over.

  I’m not going to keep going on and on about what has happened to this point in case. But here is the REAL Truth, not my version, not Overhauser/Jack’s and most assuridly the attempted to rehabilitate “saint or light” Bob P.

  The only people HARMED were the 50 innocent owner-operators that got SCREWED, their families, their employees and their families.

  They got SCREWED and HARMED by the following:

  1) Overhauser/Jack
  2) 9 Plaintiffs
  3) Bob P.
  4) 2 Attorneys representing Shamrock
  5) Kevin Spellacy
  6) Jerry Wenger

  All the ABOVE and a couple of more very minor players ALL attributed to the SCREWING received by the 50 Plaintiffs.

  Now the future, They want to simply be left alone! They don’t want to have anymore HARM come their way, They want to continue to build their businesses, they want to continue to serve their customers, they want to focus on the FUTURE!

  So, WHO am I talking too? The shame is here, we aren’t actually that far apart in the following, unfortunately because Attorneys have conditions for talking, there is simply a WALL that develops and NO ONE is wiling to come out of their corners, over those walls and speak honestly with one another anymore.

  The MODEL for commercial cleaning franchising is FLAWED. It is HUGELY Flawed! There was a reason Shamrock/Spellacy, approx. 15 other Masters in the Stratus Franchising System left. Those that left RAN their businesses in an ethical and upstanding manner, ALL of them REFUSED to do the “churn and burn” templete! Unfortunately, the MODEL wasn’t what came under fire, it was the local Master (former Master) and its Management Team.
