“DARYL PRITCHETT AND MIKE RAMEY WORK TOGETHER TO SIGN YOU UP AND THEN KICK YOU TO THE CURB. I AM WORKING ON A LAWSUIT AGAINST MATCO, HOPING TO TURN IT INTO A CLASS ACTION SUIT. YOU MAY CONTACT JERRY MARKS AT MARKS AND KLEIN LAW FIRM AT [redacted], IF YOU ARE INTERESTED.
“I INVESTED ALOT OF MONEY IN MATCO AND AFTER 3.5 YEARS THEY SHUT ME DOWN. WHEN THE ECONOMY SLOWED IN 2008,THEY PUT ME OUT OF BUSINESS.

How the court rules re: allegations that uncompensated warranty work, repairs & repossession services by dbrs is a violation of the Fair Labor Standards Act (FSLA) could have some serious ramifications for Matco and other tool franchises.

Jay, I don't know who you are? a DM or Distributor or none of the above, why the hell should I be the one to warranty the tool box? Rusting from the inside out. I did NOT build the box, MATCO Built the piece of crap. THey should warranty it.
My first DM would 'cover' me on any warranty required. THis piece of crap DM now would do NOTHING! What a minute, he did come and repaint one for Matco, but it looked so bad, the customer traded it in on a used Snapon box.
You know Jay, maybe your right, why the hell would I even need Matco, they won't warranty anything that I BUY from them, they provide no service to me for my franchise. Training is NON-existent, Sales meeting were worthless. They stole from me every chance they had ..

I find it comical that Mac is getting sued for NOT being a franchise for the same reasons that some on this thread want Matco sued for being a franchise. So, legal experts, what do you want?

First Question!
What do you do with DM or RM who FRAUDULENTLY represent themselves to a Franchisee?
How many lives have to be ruined before our court system actually does something to defend people like myself?
What should the punishment be for the DM or RM?
Shouldn't Matco be responsible for the behavior of its management?
Statement : I know for a fact that in Arkansas the penalty's are as stiff as prison time, damage awards, punitive damages and compensation for attorney fees.
So why didn't Matco management like Ernie Lauber and Mike Swanson know this about Arkansas franchise law when I drove all the way to Stow , Ohio (14hrs away) to prove the fraud and give them the opportunity to respond to all my allegations and resolve my situation amicably as it says in my franchise agreement.
What should the consequences be for ignoring me and trying to get me to sign a piece of paper which would take away my ability to persue them legally and put a gag into my mouth should I choose to tell the truth about the events surrounding my career as a Matco Franchisee?
All you people defending Matco without any real facts or details, just making personal attacks-
What shoud a DM be doing out there? IF they can't provide training assistance, they can't provide warranty claim assistance, they can't provide business assistance or any resurveying - WHAT DOES A DM DO?
Now I understand why Junior, MAtco#1 and others were so good, they did NOTHING!
Lets see, approx $5k for a new sign on, and 3-4% of distributor purchases. The only thing I see anything being done is 5-6 weeks to prepare a DM meeting.

The statement about amicably resolving conflict was from Matco's termination letter and reads "Also , I would like to take this opportunity to express Matco's desire to amicably conclude its distributor relationship with you."
It goes on to say that I should write a letter stating the issues to be addressed.
I drove all the way there and had paperwork in hand to prove what I am claiming, only to be dismissed.
Former, I beg to differ about your comment about doing nothing, just like I don't know your story you sure the he'll don't know mine!
