You must not read my post's either... Everything I've posted was factual cases were Matco has neglected to act properly in the wording of the contract.
AGAIN, The contract is one sided, they all are. I and many others have signed it with the hopes and beliefs in humanity, that they would ACT IN GOOD FAITH.
Have you talked with anyone within the American Court system? Yes, it does matter what state you live in, laws vary and so do Judges.
Just spend some time and research franchise law and some of the various court cases. SOMETIMES, and I mean sometimes, the wording of the contract means nothing, but what does matter is that both parties ACT in Good FAITH.
And yes, there is more to it. My point is Action speaks louder than words.
Why have a contract between two parties if both are going to violate that contract? And then when, and only WHEN it suits YOUR purpose, you site the violations against the other party.
I would bet, each and every distributor out there are violating that contract. When is it FAIR to act on one and not the other?
Todd is absoultely correct, I was doing great, when in 08 the economy dumped and instead of matco working with us, they kicked me out. I was in the top 5 in my district and was abidding by the rules. If you are selling the products and making money for you and matco, what the hell.Like I said before, they have their select few. My D.M.'s best friend was a distr,he was on tool hold, below average and driving 50 miles to get tools off my buddies truck, why wasn't he warned or kicked to the curb? It's called buddy system or matco favortism.
We are all here to share our opinions on what matco has done to us. Matco is not all to blame, but their policies on franchises is deceitful, illegal, and fraudulent on the way they sign people up. I take part blame and I am not afraid to admit it. I do blame them for not waiting the 14 days on the fdd, my D.M. said we need to hurry to get you in class, I beleive he had either FED EX OR UPS OVERNITE the fdd. Also, who determines the national average, If you are spending money with them, they shouldn't give a shit. I had a college in my area, I caught another distr going in there, told my D.M. and he did nothing, I also caught the same distr, going 20 miles out of his way on a saturday, selling tools and he did nothing.Thats the kind of D.M. everyone should have.
In my opinion, if they would change their policies on franchises, let the distr run their business and be honest when signing a potential distr, they would be a premiere company. You may contact Jerry at MARKSANDKLEIN.COM.

"During the three year period from 1/1/08 to 12/31/10, seven hundred fifteen (715) Distributors, forty nine percent (49%) of the total number of MATCO Tools Distributorships open at any time during the period, left the MATCO system."
"MATCO Tools has, nonetheless, continued to offer and sell Distributorships despite the pattern of early failure. "
"If a MATCO Tools distributor desired to exit the system during this three year period, and hoped to sell its business through a MATCO approved transfer, that franchisee had less than a seven percent (7%) chance of success. Statistically speaking, such a low success rate indicates that the MATCO Tools businesses run by distributors who were leaving the MATCO system were so unprofitable as to be unmarketable."
Let's say you're right and all these failing distributors are negative nellies who have themselves to blame for their failure, doesn't that AT LEAST indicate that, despite its years of doing this and thousands of dbrs having passed through its system, Matco really, really SUCKS at qualifying, screening and accepting new distributors?
Every criticism the OBC (Old Boys Club) levels at unhappy franchisees is also a criticism of Matco's dbr recruitment and approval process, is it not?

Now Tommy on the other hand, you change your story more than a politician. Early you said you made the top 50, them yesterday all of the sudden you were top 2, now today you have dropped back to in the top 5 in your district.
Todd, simple answer to your question, you probably had 800 headcount route, your RM was TN, didn't all the dm's either quit or get fired when he came to your region

All guest, why don't you post your names, do you have something to hide? There are a few men and women who have the guts to put their name, because we have nothing to hide. Are you scared of matco? Like I said many times, man-up or go away. Are you scared to get on the train, heading to stow? Tell it like you see it , that is with your name on it. It will be derailing at 4403 allen rd, thats where we are going to crash and wouldn't you like to be on it. The FEDS ARE COMING ALONG FOR THE RIDE TOO.
