CUPPY’S COFFEE: Who’s Suing Them Now?

Commenters at UnhappyFranchisee and franchise site FranchisePick.com have posted the contact information for preparing or considering group action suits against Cuppy’s Coffee, Medina Management, Elite Manufacturing, FranSynergy, Morg Morgan and/or Dale Nabors and associated entities.  The first two are leading franchisee law firms, the 3rd is a FL personal injury firm said to be “looking into” a possible action.

  • Sean/all,

I am sueing Cuppy's/Elite. My attorney has been on top of things. But Cuppy's/Elite is doing every legal thing they can to duck us. No use. A local Judge has ruled, "lets go forward with this without them." I will have my day in court against them next week. Don't know where this will go, but I'm not giving up against these crooks. Also, got a letter from the Lt. Attorney General in Florida. Apparently they have enough complaints and have refered this to criminal investigation. Dah! Took them long enough. My attorney has found that Cuppy's does still have franchises out there active. Where they are getting their supplies is unknown. Will keep all posted if and when I can about my progress.

  • Chas,

Yes, I am one of the still active "Cuppys." I wouldn't say I'm a franchisee because since there's no franchisor left I guess I'm an independant using the Cuppy's name. There are still quite a few of us out there and actually new stores are opening. These folks, like myself, have built and operated the stores entirely on our own. No one has heard from Dale since the move to Alabama and I know that there are a number of default judgements against him already. We still buy our coffee from cafe d'arte and Joe Mancuso has done a great job working with us. We were buying supplies from Fig Brothers, but I think that i about to change.

Good luck and go get em!!!!

  • Just read another comment about having a day in court next week... is there a better way to see comments and/or updated info?? Ted

  • We are still going in Colorado have not heard from anyone in Alabama either. Any news as if they are still running?

  • Jim,

They're closed down. No office left in Alabama. Everyone that followed him from FL has left. There are no more operations. We're all on our own.

  • Their finance Dept is no longer in existance however employees that were contracted and should have gotten 1099's did not get them. Is it possible there is a Federal Tax charge there? I goy my W-2 because thy had a payroll company but not my 1099 from hen I was first hired. I did however claim the amt.

  • that address is dales home address in alabama, its still good cause our process server found him and his wife natalie there

  • 3110 W. McGuire Dr.
    Muscle Shoals, AL 35661

This is Dale's House and you can actual get a street view on Google. There is a truck in the driveway. You can zoom in get the license plate and see if there may be another address it is licensed to ....just want to help
