Does DonutNV Tolerate Online Drug Sales by Franchisees? Just Not Complaints?

DonutNV Franchising Inc. continues to do everything in its power to hide franchisee complaints and unhappiness.  Despite rumors that a significant number of DonutNV franchisees have notified the franchisor that they want out of their franchise agreements, the struggling franchisor and its three law firms have effectively prohibited captive franchisees from posting their complaints on social media.  What’s evidently NOT prohibited?  The promotion of drugs not approved for human or animal consumption?  by Sean Kelly, Founder, Truth for Veterans, Truth for All Initiative

(UnhappyFranchisee.Com)  Michael Malagon is a celebrated DonutNV franchisee, a DNV cheerleader and provider of DonutNV franchisor testimonials.  His multi-trailer Fort Myers franchise is in the top 10% of franchisee sales.

Michael Malagon’s Facebook page links to the Fort Myers DonutNV page and frequently features DonutNV photos, updates, promotions and news. It also features his business selling injectable substances not approved for human or animal use.

Mike Malagon Promotes Ryder Research Supply, Mike’s Pep Talk & DonutNV Side by Side

Mike & Hayley Malagon also promote what appears to be his mysterious website and company that identifies itself only as “Ryder Research Supply – EST. 2025” with no corporate entity, officers, or physical address listed.

The Ryder Research Supply website indicates no LLC / corporation name, no state of incorporation and no ownership attribution though there is a metadata reference to being based in Fort Myers.

The site appears to be a gray-market peptide vendor that claims “Rigorous sourcing standards” and “Independent lab testing” but includes:

  • No named manufacturers
  • No disclosed labs
  • No batch traceability beyond internal “COA page”
  • No FDA registration, DEA registration, or chemical supplier credentials

After getting content repeatedly banned from Facebook, Mike Malagon also established the Mike’s Pep Talk promotional website.

What Are the “Peptides” This DonutNV Franchisee is Selling?

According to Google Gemini Research:

Peptides are short chains of amino acids, which are the building blocks of proteins. While proteins are typically long, complex chains (often containing 50 or more amino acids), peptides are much smaller.

In the body, peptides act as signaling molecules. They tell your cells and organs what to do—such as “produce more collagen,” “release growth hormone,” or “reduce inflammation.” Because they are naturally occurring and highly specific in their functions, they have become a major focus of medical research and the wellness industry.

Is it illegal to sell peptides for human consumption?

The legal status of peptides is complex and depends entirely on how they are marketed and their specific classification.

1. FDA Approval and Regulation

In the United States, the FDA regulates peptides based on their intended use:

  • Approved Drugs: Some peptides (like Insulin or Ozempic) are FDA-approved. It is legal to sell these, but only by prescription through licensed pharmacies.
  • Unapproved Drugs: Many popular “wellness” peptides (such as BPC-157, TB-500, or Melanotan) have not been approved by the FDA for human use. Selling these for human consumption—meaning marketing them as supplements or treatments—is generally illegal.

2. The “Research Chemicals” Loophole

You may see peptides sold online labeled “For Research Purposes Only” or “Not for Human Consumption.”

  • This is a legal gray area used by vendors to sell unapproved substances.
  • If a company sells a peptide with this label but provides dosage instructions, testimonials about health benefits, or “human use” marketing, the FDA considers this misbranding, and the sale becomes illegal.

DonutNV Franchisee Promotes Injectable Substances Not Approved for Human OR Veterinarian Use

Mike Malagon’s posts and websites display the legal disclaimer (wink wink“For Research Purposes Only” or “Not for Human Consumption.”

However, Google Gemini states that “If a company sells a peptide with this label but provides dosage instructions, testimonials about health benefits, or ‘human use’ marketing,” the FDA consider the sale illegal.

The Ryder Research site provides dosing instructions and Mike Malagon provides weight loss claims that include himself and members of his online group (who lost 500 pounds between them).

In writing my ongoing analysis and expose on DonutNV (due to being 15 months into a bullying defamation lawsuit with them), I am frequently amazed at the irrational and self-destructive decisions I encounter.

Some of those decisions are small and insignificant – like Malagon’s recruitment ads for “Baking Associates” when they do no baking (their donuts are deep-fried).

Other irrational and potentially self-destructive decisions are more significant – like promoting what may be deemed illegal drugs on the same page as an established business… a business that depends on access to elementary and secondary schools.

What if the FDA or other law enforcement agencies decide to publicly crack down on the Malagon’s sale of unregulated substances?

Would the school districts in their area continue to welcome DonutNV onto school grounds?

Or would the Malagons joins the legions of other former DonutNV franchisees?

Does DonutNV Franchising Inc. Think an FDA Crackdown Wouldn’t Affect its School-Dependent Brand?

Did DonutNV Franchising Inc. consider how would a national story affect the already-struggling DonutNV franchisees across the country?

Did they consider how hard it will be to argue, in mediation/arbitration/defamation proceedings, that they aggressively protect their brand image when they allow franchisees to promote shadowy businesses and sell unapproved injectable drugs right next to their DonutNV branded content?

As I was pondering these questions, Google Ai provided a possible explanation:

Taking unprescribed peptides—especially those sourced from “research chemical” websites—can absolutely interfere with logical and rational thought. Because peptides act as powerful signaling molecules that cross the blood-brain barrier, they can disrupt the very chemistry that governs decision-making, mood, and cognitive clarity.

Well, that explains a lot.
