Michael Malagon, the Fort Myers franchisee of DonutNV mobile mini-donuts, is an aggressive and active social media marketer, school fundraising promoter, and father of young children. According to Google Gemini, Mike Malagon also meets the definition of “Drug Dealer.” by Sean Kelly, founder, Truth for Veterans, Truth for All Initiative.
(UnhappyFranchisee.Com) Mike Malagon, the Fort Myers franchisee of DonutNV mobile mini-donuts, is an aggressive and active social media marketer, school fundraising promoter, and online drug dealer.

Malagon’s profile on his Facebook page features links to his two companies, DonutNV Fort Myers FL (https://www.facebook.com/DonutNVFortMyersFL/) and Ryder Research Supply (RyderResearch.Co). He also operates a pep tides Facebook group and a website called Mike’s Pep Talk.
On his Facebook page, Malagon promotes his on-site donut trailer visits to Lee County, FL schools for such events as prom and school dances, sports events, back-to-school, teacher appreciation and more.
His DonutNV on-site trailers feature buckets of deep-fried mini-donuts coated with sugary glazes and indulgent topping like oreos and gummy worms, and sugary lemonade. Schools receive a portion of sales according to his posts.
On the same Facebook page, next to family photos and trips with his kids to Disneyworld, Michael Malagon also pushes drugs with names like Retatrutide, Semaglutide, Tirzepatide, BPC-157 , CJC / IPA and PT-141.
Despite his disclaimers stating that these injectable drugs, known a peptides, are not approved for human or veterinary use, Malagon promotes these products to consumers for weight loss, addiction, sexual health and other health issues.
As a hands-on, on-site vendor to Lee County Schools, Mike Malagon’s promotion and/or facilitation of his drug business from his cell-phone within 1000 feet of any Lee County School could potentially have severe criminal and financial repercussions.
The fallout from negative publicity alone could potentially result in the loss of school contracts and/or termination of his franchise agreements.
Despite public exposure nearly a week ago, Mike Malagon’s online drug business, social media promotions and affiliate program for would-be drug dealers is still active and open for business.
Selling Controlled Substances Within 1000 Feet of a School Carries Enhanced Penalties in Florida

Based on Florida Statutes and the School District of Lee County (SDLC) policies, the sale or distribution of unapproved substances like peptides on school grounds (including electronic or digital sales) is strictly prohibited through several overlapping regulations.
New Florida laws (HB 379 and HB 1105) not only restrict student cell phone use, they also empower schools to confiscate devices used for unauthorized purposes. Using a phone to facilitate the sale of unapproved substances would violate district technology and conduct policies.
As a hands-on DonutNV franchisee who is frequently on elementary, middle and high school grounds, selling these substances via cell phone is especially dangerous legally. Florida Statute 893.13 imposes enhanced penalties—often upgrading a third-degree felony to a second-degree felony—for distributing controlled or unapproved substances within 1,000 feet of a school.
Will School Districts Overlook Legal & Reputational Liability for DonutNV Un-Smart Snacks?
Lee County schools limit the sale of foods that don’t meet “Smart Snacks in School regulation. High sugar and caloric content already put DonutNV at a disadvantage… will Lee County schools also overlook the possibility of a vendor conducting controversial and/or illegal sales just for a cut of the day’s donut sales?
Will DonutNV and Gross Franchise Group PLC Protect its Brand & Public Safety?
DonutNV Franchising Inc. has added strict language to its franchise agreements prohibiting franchisees from joining Facebook groups or websites without prior written approval.
DonutNV Franchising Inc. has reportedly threatened franchisees with litigation for vaguely negative opinions voiced online.
At least one franchisee reports having been threatened with litigation if comments the franchisor deemed negative weren’t deleted immediately.
According to its current franchise agreement,
DonutNV Franchising may terminate this Agreement… without opportunity to cure, if (xiv) Franchisee or any Owner is accused by any governmental authority or third party of any act, or if Franchisee or any Owner commits any act or series of acts, that in DonutNV Franchising’s reasonable opinion, is morally offensive, is a significant violation of DonutNV Franchising’s company values, or attracts or could attract significant negative attention to the DonutNV brand…
